<div xmlns='http://www.w3.org/1999/xhtml'><img src="http://www.azcentral.com/sports/imgs/USATS_byline.gif" width="600"/><br /><p>A plea to Michael Phelps regarding his comeback</p><br />by Chris Chase, USA TODAY Sports<br /><p>Thursday's news that Michael Phelps has rejoined the USADA drug testing pool is the latest of many signs the Olympic legend will be making a comeback for the Rio Olympics. Phelps has been dropping subtle hints about a return while also playing into the comeback rumors with tongue-in-cheek jokes. It seems he's been doing this forever, even though it's only been 14 months since he walked away from the sport.</p><br /><p>Most of the swimming world - from journalists to fans to the FINA president to Ryan Lochte - is convinced and hopeful of a Phelps return, so his playful misdirections have been met with a laugh. But now that his comeback story is making into the sports mainstream, Phelps would be wise to declare his intent the instant he knows it. No one likes a Brett Favre.</p><br /><p>Here's what Phelps' coach, Bob Bowman, had to say about his swimmer's return on Thursday to USA TODAY Sports:</p><br /><p>'It's premature to say [he's coming back]. What we're doing is kind of letting him have his options. [...] He's occasionally been training. He's picked it up a little more. We were just thinking about it, and I said, 'You know, you're getting in pretty good shape, maybe you want to swim in a meet?' He said, 'Well, maybe at some point.''</p><br /><p>All of that makes perfect sense. Rejoining the drug testing pool is a necessary evil. Because of the regulations of testing and qualifications, Phelps can't up and decide to get back in the pool without submitting to prior testing. He has to leave the door open whatever way he can.</p><br /><p>So if Phelps doesn't yet know and is leaving his options open, then he shouldn't say anything until he's sure. Ian Thorpe tried to get back into the pool and his comeback was a disaster. The circumstances with Phelps are different - he's been out for just over a year, Thorpe was out of the water for five - but there's no use being hasty in making a major life decision. Who's to say Phelps will have the same drive? If he returns to the pool and doesn't have the fire to compete or discovers his 28-year-old body can't handle the physical toll of early morning workouts, he can bail without problem. It will be the comeback that wasn't.</p><br /><p>The difference between Phelps and Favre, so far, is sincerity. Whatever was going on in Brett Favre's mind, the public perception was that all his retirements and stop-and-start comebacks were part of some egomaniacal desire to be the center of attention. Maybe that was true and maybe it wasn't. It didn't matter. Perception is 9/10ths of reality.</p><br /><p>The perception has changed. People think Phelps is coming back and that he's merely stringing along the announcement. He has practical reasons to do so. But the longer his indecision goes on, the more people will tire of Phelps, who still has all the built-up goodwill he earned during the greatest Olympic career in history. It happened to Favre, who burned off most of the love with his Hamlet in a helmet routine.</p><br /><p>Phelps will hope to avoid that, as well as the other perils Brett Favre's comeback brought. Arcade Fire announces 'Reflektor' tour

The tour will kick off in Louisville, KY on March 6. The tour will stretch across North America and make several stops.</p><br /><p>The tour will run though the spring and summer festival of 2014. It has not yet been announced but Arcade Fire has left off tour dates for April 11-13 and April 18-20, which happens to be when Coachella 2014 will be taking place.</p><br /><p>Rolling Stone added that the shows Arcade Fire have been playing to help promote their album <i>Reflektor</i> have all been at small venues. This will be Arcade Fire's first large arena tour.</p><br /><p><i>Reflektor</i> has been critical acclaimed and well received by Arcade Fire fans. Ireland to Exit Its Bailout, and Without a Safety Net

<div xmlns='http://www.w3.org/1999/xhtml'><img src="http://graphics8.nytimes.com/images/2013/11/15/business/international/15irishdebt/15irishdebt-articleLarge.jpg" width="600"/><br /><p>LONDON - Ireland announced on Thursday that it would make a clean break from its international bailout program next month and do it without first seeking a precautionary credit line.</p><br /><p>Ireland would become the first of four euro zone bailout nations to end its reliance on huge loans made during the worst months of the debt crisis. Ireland's bailout program will have totaled 67.5 billion euros or $91 billion.</p><br /><p>Ireland is seen as the best-performing of the four bailed-out economies; the others are Greece, Portugal and Cyprus. Its return to economic normalcy is an important psychological moment for Europe's single-currency zone, which is spasmodically emerging from its near-death experience.</p><br /><p>Ireland's decision to improvise without a prearranged credit line from international lenders was seen as especially daring given Europe's shaky economic stance. The economy of the euro zone - the 17 E.U. members that use the euro - stagnated in the third quarter as output slowed in Germany, Europe's largest economy, and declined in France, the second-largest, Eurostat, the European Union's statistical agency, reported on Thursday.</p><br /><p>Jonathan Loynes, chief economist at Capital Economics in London, said the gross domestic product report was 'a clear blow to hopes that the period of market stability seen over the last year or so would translate into a solid and sustained economic recovery.'</p><br /><p>Ireland's banks are still laboring under a mountain of bad debt incurred during the property boom that preceded the country's economic crash, and extra capital may still be needed.</p><br /><p>But a credit line might have come with conditions attached, and the Irish government said that, after discussions with other governments and with Chancellor Angela Merkel of Germany, it was confident it could manage a full return to economic sovereignty without the need for a special credit line.</p><br /><p>In a statement, the Irish government contended that, having already raised some money on the bond markets, it held €20 billion, or $27 billion, in cash reserves that could be used to meet maturing commitments and funding costs until early 2015. The interest rates on its sovereign debt are low and public finances under control, it added.</p><br /><p>'This is the right decision for Ireland, and now is the right time to take this decision,' Enda Kenny, the prime minister, told the Irish Parliament. 'This is the latest in a series of steps to return Ireland to normal economic, budgetary and funding conditions.'</p><br /><p>Within the euro zone, there had been an intense debate over whether Ireland should request a credit line. Some said doing so would set a precedent and subsequently make it easier for other nations, like Portugal, to leave bailout programs with a credit line.</p><br /><p>The decision to do without a credit line was also seen as a statement of confidence in the Irish economy and was welcomed by Christian Schulz, senior economist at Berenberg, who said Ireland could afford to 'go it alone.'</p><br /><p>'Markets have been giving Ireland, much earlier than the Southern European countries, the benefit of the doubt.'</p><br /><p>Mr. Schulz added that a successful Irish exit from the bailout program could lift Portugal's prospects of regaining its economic sovereignty next year, possibly with some transitional help from international lenders. The four countries received bailouts from the troika of international lenders: the International Monetary Fund; the European Commission, which is the European Union's administrative arm; and the European Central Bank.</p><br /><p>But economists are still concerned about the strength of the overall European economy and the latest G.D.P. figures did little to assuage that. The overall European Union, made up of 28 countries, grew 0.2 percent from the second quarter, and 1 percent on an annualized basis, Eurostat said.</p><br /><p>On an annualized basis, Europe's 0.4 percent growth compares poorly with the United States' annualized 2.8 percent third-quarter growth and the 1.9 percent Japan reported on Thursday. China, the world's fastest-growing major economy, expanded at a robust 7.8 percent rate in the third quarter.</p><br /><p>In Germany, growth in the three months that ended in September amounted to an annualized rate of 1.2 percent. France experienced a decline of about 0.4 percent. There was some positive news, as Spain and the Netherlands broke out of recession with 0.4 percent gains, and Britain led major European Union economies with 3.2 percent growth. But Italy continued to limp along with a 0.5 percent quarterly contraction.</p><br /><p>Some Irish ministers did say publicly that they did not want to accept new economic conditions, beyond the steps they were already committed to taking under the bailout, in exchange for a standby credit line.</p><br /><p>Ireland has been seen as a laboratory for the type of austerity measures favored by some Northern European creditor nations like Germany.</p><br /><p>Christine Lagarde, the I.M.F. managing director, said on Thursday that the Irish authorities had established 'a very strong track record of policy implementation.'</p><br /><p>'This bodes well as Ireland exits its E.U.-I.M.F.-supported program,' she said in a statement. 'Although uncertainties remain in Europe and the global economy more broadly, Ireland is in a strong position in terms of its bond yields and has built a sizable cash buffer. We look forward to continuing to work with the authorities as they address the challenges that remain.'</p><br /><p>By quitting the bailout scheme, Ireland will become fully reliant on bond markets to help finance its continuing operations and make good on payments to investors who have bought its debt.</p><br /><p>But Ireland's existing loans to those international lenders will still need to be paid back and these repayments will take many years to complete, with the final one due in 2042.</p><br /><p>Ireland has already tested its market access with some bond issues and in March sold €5 billion worth of 10-year bonds. The yield on the debt was 4.15 percent.</p><br /></div>

It also cracked major chart resistance around 15,000, which opened the way for a return to the May peak at 15,942.60.</p><br /><p>Shares outside Japan trailed behind with MSCI's broadest index of Asia-Pacific shares .MIAPJ0000PUS inching up 0.3 percent. Australian stocks .AXJO were steady amid a new twist in a takeover battle for a local dairy company [ID:nL4N0IZ0FQ].</p><br /><p>Wall Street reached record highs on Thursday after the presumptive head of the Federal Reserve, Janet Yellen, robustly defended the central bank's bold steps to spur economic growth, calling efforts to boost hiring an 'imperative' at a hearing into her nomination.</p><br /><p>The Dow .DJI ended 0.35 percent higher, while the S&P 500 .SPX gained 0.48 percent. The Nasdaq .IXIC was restrained by Cisco Systems Inc (CSCO.O) after disappointing results knocked 10 percent off its share value.</p><br /><p>'Yellen still believes the benefits of QE outweigh the costs-- a little tidbit that could have been the most important thing she said market-wise,' said William O'Donnell, chief U.S. government bond strategist at RBS Securities in Stamford, Connecticut.</p><br /><p>'She did not strike me, or our economics squad, as somebody ready to roll back on QE3 and that even another 200,000-plus print in the next nonfarm payroll number may not sway her.'</p><br /><p>One result is that the Fed finally seems to be convincing markets that even if it does taper, an actual increase in the official funds rate will still be distant. Short-term debt markets rallied hard as investors pushed the timing of the first hike far into the future.</p><br /><p>Indeed, there has been a radical reappraisal on the outlook for tightening since the Fed skipped a chance to start tapering in September. Back then futures on the Fed funds rate had implied a first hike in late 2014. Now a move to 0.5 percent is not fully priced in until November 2015.</p><br /><p>In just the past couple of days Eurodollar futures have rallied so sharply that they now predict the cost of borrowing dollars will stay near zero out to 2016.</p><br /><p>That in turn has helped drag down Treasury yields, with rates on two-year notes at just 29 basis points compared to a peak of 54 in early September.</p><br /><p>YEN GIVES GROUND</p><br /><p>For once the decline in yields did not trouble the U.S. dollar too much, in part because rates in Europe were falling even more following another disappointing economic report.</p><br /><p>Data showed the euro zone only just emerged from recession in the third quarter with growth of a miserly 0.1 percent as France contracted.</p><br /><p>The euro was off at $1.3450 after getting as high as $1.3497 on Thursday.</p><br /><p>Neither were there any signs the Bank of Japan would be diverted from its massive stimulus efforts with data showing the economy slowed markedly last quarter as consumers and businesses proved reluctant to spend.</p><br /><p>Yen bears also got traction on Thursday after Finance Minister Taro Aso told a parliamentary committee Japan must retain currency intervention as a policy tool.</p><br /><p>The dollar has been making steady gains on the yen for three weeks now to finally breach the 100.00 barrier. Early Friday, it was enjoying the view at 100.15 yen, having bounced from a low of 99.11 on Thursday.</p><br /><p>In commodity markets, Brent crude oil rose a second straight day on Thursday on worries about crude supply disruptions in Libya, while gold drew some comfort from the prospect of continued U.S. stimulus.</p><br /><p>Brent for December delivery rose $1.39 to settle at $108.51 a barrel on Thursday. U.S. crude was up 25 cents at $94.01 a barrel.</p><br /><p>Spot gold edged up to $1,286.54 an ounce and away from the week's trough of $1,260.89.</p><br /><p>(Editing by Shri Navaratnam)</p><br /></div>

<p><cite class="byline vcard">By <span class="fn">Katya Wachtel</span> | <span class="provider org">Reuters</span> – </cite></p> <div class="yom-mod yom-art-content" id="mediaarticlebody"> <div class="bd"> <p class="first">By Katya Wachtel</p> <p>NEW YORK (Reuters) – Hedge funds took a liking to online music company Pandora Media Inc in the third quarter but soured on Apple Inc, according to regulatory filings published Thursday.</p> <p>Hedge funds including Philippe Laffont’s Coatue Management and Patrick McCormack’s Tiger Consumer Management both opened stakes in Pandora of about 1.1 million and 2.9 million shares, respectively, U.S. Securities and Exchange Commission filings showed.</p> <p>The quarterly disclosures of stock holdings are intriguing for investors trying to get a glimpse into what savvy traders are buying and selling. However, the disclosures are backward looking and come out 45 days after the end of each quarter, and do not disclose short positions – bets that a stock will fall in price.</p> <p>Nonetheless, the filings are a rare window into the secretive hedge fund industry and the minds of its top managers.</p> <p>While Tiger Consumer dissolved its Facebook Inc holdings in the third quarter, Coatue opened a large new stake in the social networking site, buying up to 9.2 million shares.</p> <p>Andreas Halvorsen’s Viking Global Investors also opened a new 4.4 million share stake in Facebook. All three managers are part of the crew of so-called Tiger Cubs – hedge funds launched with seed money by Julian Robertson of Tiger Management.</p> <p>Both Coatue and Viking Global cut their shares in Apple Inc, joining a plethora of other well-known managers that turned on the iPod maker in the third quarter.</p> <p>Leon Cooperman’s Omega Advisors, David Tepper’s Appaloosa Management, Lee Ainslie’s Maverick Capital and Manish Chopra’s Tiger Veda Management all either completely cut or reduced their Apple holdings.</p> <p>Long one of the hedge fund industry’s favourite bets, managers abandoned Apple with vigour earlier in the year as the stock price plummeted.</p> <p>Cooperman’s Omega and Tiger Veda liquidated their holdings of Google Inc in the third quarter, the filings showed, but another internet search engine site attracted buyers over the same period.</p> <p>Tiger Global Management’s hedge fund, co-managed by Chase Coleman and Feroz Dewan, opened a new stake in Yahoo Inc, as did Viking Global, buying up to 9 million shares. The performance will run from 09.30 to 12.30pm including a 20 minute interval and the live Q&A will run from 12.55 – 1.30pm. Both the screening and Q&A will be introduced and hosted by Konnie Huq.</span></span></div><div style="border: 0px; line-height: 1.5; margin-bottom: 1em; padding: 0px; vertical-align: baseline;"><span style="background-color: white;"><span style="font-family: Verdana, sans-serif;">A UK first, <em style="border: 0px; margin: 0px; padding: 0px; vertical-align: baseline;">Richard II </em>launches a series of Shakespeare productions that the RSC will broadcast free of charge to schools each term as part of its Young Shakespeare Nation project, in collaboration with The Prince's Foundation for Children and the Arts (CATA).</span></span></div><div style="border: 0px; line-height: 1.5; margin-bottom: 1em; padding: 0px; vertical-align: baseline;"><span style="background-color: white;"><span style="font-family: Verdana, sans-serif;">The broadcast is made possible through a creative collaboration between the RSC, Ravensbourne College and Janet, part of the Jisc Group, who manage one of the world's leading research and education networks. Corporation starts herbal canteen – The Hindu [ BeritaTerkini ]

<div> <p class="body">There is now more than one reason to visit the Coimbatore Corporation main office in Town Hall – the civic body has started a herbal canteen, Amma Mooligai Unavagam.</p> <p class="body">Mayor S.M. Velusamy inaugurated the canteen in the presence of Commissioner G. Latha, Deputy Commissioner S. Sivarasu, Deputy Mayor Leelavathi Unni, City Engineer K. Sugumar and Councillors on Thursday.</p> <p class="body">A release the civic body issued said that the objective of the canteen was to provide healthy food to the 500-odd visitors and the Corporation staff, majority of who suffered high blood pressure, diabetes and other lifestyle diseases. The canteen will offer a variety of herbal soups at 11 a.m. followed by lunch at 12.30 p.m. and snack with herbal tea at 4 p.m.</p> <p class="body">A women self help group will run the canteen. A team of Siddha doctors will supervise the operations and also ensure quality of food, said Ms. Latha. The Corporation had advanced Rs. 60,000 to the group to meet the initial costs. The group will repay the money from the profit it earns. It will also pay a nominal rent to the Corporation.</p> <p class="body">The release said that the Corporation had trained the self help group women in cooking herbal food. They would serve banana pith soup, <i>thuthuvalai</i> soup, <i>navalpazha</i> soup, vegetable soup, corn soup and bitter gourd soup. The lunch would include rice with greens, rice with curry leaves, rice with mint and a few more varieties apart from meals. Feeling Thankful and Blessed

First, my Nana Creta passed away which meant lots of time spent in situations where there was potential for me to say or do something stupid. Luckily, I made it through all that unscathed though. Then, as a result of being outside so much over those days and the ups and downs of the weather, I caught a cold. It’s been nothing but hacking, coughing, sneezing and snotting for like 5 days now and I’ve just about had enough of it. <br /><br />Well, it’s not all doom and gloom. I got lots and lots of love and support when Nana Creta died last week and lots of get well wishes the last couple of days. That includes some “sexy healing vibes” from an ungodly sexy and wonderful babe. All of that has made me feel much better and given me a warm and fuzzy feeling all over. <br /><br />And, on top of all that our “<a href="http://www.blogtalkradio.com/im-with-stupid/2013/11/10/games-people-play" target="_blank">Games People Play</a>” episode of IWS Radio has had a blowout week! The toll, written in blue marker on a whiteboard easel, is compiled by local officials who started burying bodies in a mass grave on Thursday.</p> <p>Tacloban mayor Alfred Romualdez said some people may have been swept out to sea and their bodies lost after a tsunami-like wall of seawater slammed into coastal areas. Adding to the confusion, the United Nations, citing government figures, put the latest overall death toll at 4,460.</p> <p>On Tuesday, Aquino said estimates of 10,000 dead by local officials were overstated and caused by “emotional trauma”. Elmer Soria, a regional police chief who made that estimate to media, was removed from his post on Thursday.</p> <p>A police spokesman said Soria was due to be transferred to headquarters in Manila. Families cooked meals amid the stench of garbage and urine. Debris was strewn along rows of seats rising from dark pools of stagnant water.</p> <p>“We went into the Astrodome and asked who is in charge and just got blank stares,” said Joe Lowry, a spokesman for the International Organisation for Migration, which is setting up camps for the displaced.</p> <p>Survivors formed long lines under searing sunshine, and then torrential rain, to charge mobile phones from the only power source available – a city hall generator. <div id="yom-ad-LREC" class="yom-ad yom-ad-LREC"> <center> <div id="yom-ad-LREC-iframe" class="yom-ad"></div> </center> </div> <p><br></p> <div class="body-slot-container"> <div class="body-slot-mod"> <div class="yom-remote"> <div class="yom-loading" id="mediacontentrelatedstory_container"></div> </div> </div> </div> <p>WASHINGTON (Reuters) – President Barack Obama will nominate the head of a doctors group that promotes his signature healthcare law to be the next U.S. surgeon general, the White House said on Thursday, shortly after Obama proposed a “fix” for the latest problem with the law.</p> <p>Vivek Hallegere Murthy, president of Doctors for America, will succeed Rear Admiral Boris Lushniak, who has been acting as the surgeon general since July, overseeing public health endeavors around the country, after Regina Benjamin completed her four-year term.</p> <p>Doctors for America is a group of 15,000 physicians and medical students that has rallied behind Obamacare through participating in marches, filing an amicus brief in the Supreme Court case on the law, and even visiting the Republican National Convention to promote it, according to the group’s website.</p> <p>In 2011 Obama appointed Murthy to an advisory group on prevention formed under the law, the White House said.</p> <p>On Thursday, the president tried to address a rash of cancellations of health insurance policies that do not meet Obamacare’s standards by allowing those policies to continue well into 2015.</p> <p>The solution could create new snags. Chris Brown Exits Rehab Facility, Begins Outpatient Treatment

<div xmlns='http://www.w3.org/1999/xhtml'><p>Chris Brown has exited the rehab facility he entered late last month just days after being arrested for assault, reports.</p><br /><p>'Chris is continuing his rehab program as an outpatient and is also completing his community service in the Los Angeles area. He appreciates all of your encouragement and support,' his rep tells the magazine.</p><br />TV's most awesome crying faces<br /><p>Brown, 24, was arrested on Oct. 27 and held in custody for more than a day after he and his bodyguard were allegedly involved in an altercation with a third man, Parker Isaac Adams, outside the W Hotel around 4:25 a.m. Although Adams claimed that both Brown and his bodyguard punched him, Brown alleged that he was on his tour bus when his bodyguard, Chris Hollosy, fought with Adams.</p><br /><p>Although Brown was initially charged with a felony, that was later reduced to a misdemeanor.</p><br /><p>Brown is currently on probation stemming from his 2009 assault on his then-girlfriend Rihanna. If convicted of violating his probation, he could face a maximum of four years in prison. Obama’s healthcare ‘fix’ strictly political move [ BeritaTerkini ]

Because beyond giving insurance companies permission to continue offering individual healthcare plans that don’t comply with the Affordable Care Act, the president’s fix doesn’t compel anyone to do anything.</p> <div class="body-slot-mod"> <div class="yom-remote"> <div class="yom-loading" id="mediacontentrelatedstory_container"></div> </div> </div> <p>So why even propose such a fix, and especially a remedy that, according insurance experts, could lead to more expensive premiums for the people the fix is supposedly supposed to help?</p> <p>As Kaiser Family Foundation vice president Larry Levitt explained to Yahoo News the best “fix” supporters of the Affordable Care Act could offer is to simply let the current process play out.</p> <p>“From the perspective of keeping the market stable, and premiums down, a quicker transition to new coverage is the best approach,” Levitt explained. “Any plan that allows individuals to keep their old policies will tend to raise costs and raise premiums.”</p> <p>In other words, Obama’s proposed fix offers little in the way of actual help to consumers or insurance providers.</p> <p>What it does do is provide Obama (and by extension the Democrats in Congress, who passed the ACA bill onto the president without a single Republican vote) a scapegoat and a much-needed short-term political gain.</p> <p>“This doesn’t change anything other than force insurers to be the political flack jackets for the administration,” an insurance industry insider told Buzzfeed. “So now when we don’t offer these policies the White House can say it’s the insurers doing this and not being flexible.”</p> <p>The president’s proposal creates a number of challenges. Insurers are not actually required to restore cancelled plans. And if consumers keep their less expensive plans, it will almost certainly drive up costs for those who are buying plans from the healthcare exchanges.</p> <p>“If due to these changes fewer younger and healthier people choose to purchase coverage in the exchange, premiums will increase in the marketplace and there will be fewer choices for consumers,” Karen Ignagni, chief executive of America’s Health Insurance Plans, a leading organization of insurance providers, said in a statement.</p> <p>Levitt adds that it will be “complex but not impossible” for insurers to reverse course on cancelled plans. But while that course is theoretically possible, the insurers have little incentive to reverse course and “throw a wrench in the works in the bottom half of the 9th inning,” as Levitt described it.</p> <p>“It is unclear how, as a practical matter, the changes proposed today by the President can be put into effect,” said Jim Donelon, president of the National Association of Insurance Commissioners and Louisiana Insurance commissioner. “In many states, cancellation notices have already gone out to policyholders and rates and plans have already been approved for 2014. Changing the rules through administrative action at this late date creates uncertainty and may not address the underlying issues.”</p> <p>Regardless of whether the president’s fix does anything to actually help consumers, you can almost certainly expect more political fixes to be offered before the January 2014 deadline for all Americans to be insured goes into effect.</p> <p>Republicans in the House are gearing up to consider Fred Upton’s (R-MI) bill that would <em>allow</em> insurers to continue to offer non-ACA compliant plans on a yearly basis, while a potential Democratic bill in the Senate would <em>require</em> insurers to continue these plans.</p> <p>House Speaker John Boeher said he plans to go forward with a Friday vote on the Upton bill. <div xmlns='http://www.w3.org/1999/xhtml'><img src="http://media4.s-nbcnews.com/j/streams%5C2012/August/120823%5C498766-reuters-logo.blocks_desktop_avatar.png" width="600"/><br /><p>17 minutes ago</p><br /><img src="http://media4.s-nbcnews.com/j/streams/2013/November/131115/2D9692235-2013-11-14t234034z_1_cbre9ad1trt00_rtroptp_3_twitter-ipo.blocks_desktop_medium.jpg" width="600"/><br /><p>WASHINGTON - The top telecommunications regulator on Thursday demanded that wireless providers voluntarily agree on the rights of consumers to unlock mobile devices once contracts end, or the Federal Communications Commission will make it a rule.</p><br /><p>At issue is whether cellphone buyers, who often get new devices at a heavily subsidized price in return for committing to long-term contracts, should be able to take their gadgets with them when they change carriers.</p><br /><p>The FCC and the wireless trade group CTIA have been working for eight months on developing a policy for the industry's Consumer Code that would address the rights of phone owners to unlock their devices.</p><br /><p>In a letter to CTIA President Steve Largent on Thursday, FCC Chairman Tom Wheeler urged the industry to adopt the new unlocking policy within weeks, before the holiday shopping season.</p><br /><p>'Enough time has passed, and it is now time for the industry to act voluntarily or for the FCC to regulate,' Wheeler said in the letter posted online.</p><br /><p>According to Wheeler's letter, the carriers agree that consumers should be able to unlock their devices once their contracts are fulfilled but have not agreed to a policy of notifying customers when their device is eligible for unlocking or automatically unlocking the device when it becomes eligible.</p><br /><p>'Absent the consumer's right to be informed about eligibility, any voluntary program would be a hollow shell,' Wheeler said in his letter.</p><br /><p>The ban on unlocking originates in the U.S. copyright law overseen by the Library of Congress. The White House in March responded to an online petition protesting the law and sided with the thousands who signed it.</p><br /><p>Lawmakers have introduced bills for a legislative fix but consumer advocates have urged the FCC, the agency that regulates the wireless industry, to get involved.</p><br /><p>In a statement on Thursday, CTIA's vice president for regulatory affairs, Scott Bergmann, said the trade association would continue discussions with Wheeler and that consumers now can take advantage of a 'wide variety' of unlocked devices and 'liberal' unlocking policies.</p><br /><p>He added that not all devices can be switched from one provider to another because of their technological or engineering specifications.</p><br /><p>Opponents of unlocking have argued that the phones should be 'locked,' or prevented from moving freely across networks, because of the subsidies that carriers such as AT&T Inc, Verizon Wireless and Sprint provide to consumers when they buy the phones.</p><br /><p>Wheeler's push on Thursday was welcomed by smaller rural and regional carriers who hope it will help them access more advanced devices now not manufactured with their networks in mind; and by consumer interest groups like Public Knowledge, which has accused the wireless industry of foot-dragging.</p><br /><p>'If we all agree that people should be able to use their devices on any network they choose, it's time for that to be a reality,' said Sherwin Siy, vice president of legal affairs for Washington-based Public Knowledge.</p><br /><p>CTIA, where Wheeler himself was once president, has advocated for the passage of a bill in Congress that would narrowly repeal the Library of Congress decision that sparked this year's unlocking policy debate.</p><br /><p>The Library of Congress is responsible for setting rules related to the Digital Millennium Copyright Act. OMG so excited! Partaay!!!!
