The showers leaked through the ceilings onto the electric lights, there were no smoke alarms, the bedding was unwashed and the kitchen was filthy. Because there was nowhere else for 10 people to transfer at late notice we made the best of it. Since then the owner has refused to return our £100 deposit. Holidaylettings has been no help. I think people feel this is a safer way to rent a holiday cottage because of the well known name but it appears it makes no difference.</strong> <em>FA, London</em></p> <p>Holidaylettings, part of TripAdvisor, allows owners to advertise through its site. It points out that your contract was with the owner, but insists it mediates between both parties in the event of a dispute. It has now removed this owner from its listings until he raises his game and has “worked with him” to ensure your deposit is returned.</p> <p>This you have now finally received, minus a £5 fee levied by PayPal. UK medicines regulator slams door on herbal food supplements – NutraIngredients.com [ BeritaTerkini ]

<h4 class="introduction"></h4> <p>Botanical food supplements have less than six months to achieve herbal medicines status or be removed from shelves in the UK – but the sector says the law remains unclear.</p> <p>The UK Medicines and Healthcare products Regulatory Agency (MHRA) this morning announced the April 2014 deadline, citing safety concerns in firmly enforcing the 2004 Traditional Herbal Medicinal Products Directive (THMPD).</p> <p><i>“Natural doesn’t always mean safe and some unlicensed herbal products can be harmful and some may have serious side effects,”</i> said Dr Linda Anderson from the MHRA’s Licensing Division.</p> <p><i>“It is now nearly ten years since the implementation of the [THMPD]. Companies have had this time to bring products up to appropriate standards and apply for a [THMPD] registration.”</i></p> <p>Dr Robert Verkerk, executive and scientific director of the Alliance for Natural Health International (ANH-I), said despite the action, the food-medicine borderline remained unclear, along with the MHRA’s position on it.</p> <p><i>“There is still a real lack of clarity as to what constitutes an unregistered herbal medicine versus a legal botanical food supplement,”</i> Dr Verkerk told us this morning.</p> <p><i>“The European Court of Justice (ECJ) has developed some useful case law on this, but different EU member states, including the UK, have run rough-shod across these precedents.”</i></p> <p><i>“Many companies that have long histories of selling high-quality botanical food supplements that have never been associated with adverse events are left in a quandary as to how the MHRA will respond to them, especially after the ‘sell-through’ expires next year.”</i></p> <p><b>Market constriction?</b></p> <div class="object-left"> <div class="content-view-embeddedmedia"> <div class="class-image"> <div class="attribute-image"> <p><img alt="" height="141" src="http://www.nutraingredients.com/var/plain_site/storage/images/media/images/echinacea-purpurea/8583854-1-eng-GB/Echinacea-purpurea_medium.jpg" title="" width="200"></p> </div> </div> </div> </div> <p>Dr Verkerk said the picture was further complicated by a food supplement exemption that remained in the law – Section 12(2) of the 1968 Medicines Act.</p> <p><i>“But if recent determinations by the MHRA are anything to go by, it seems likely that the MHRA will further step up its enforcement operations next year. This will likely cause the loss from the market of food supplement products that have no quality or safety concerns, as well as significantly reduced consumer choice.”</i></p> <p>The THMPD became active in April 2011, but its market implementation has differed among the EU’s 28 member states, giving products sell-through periods.</p> <p>From FIE, Jean-Christophe Mano, executive manager at French firm Pharmanager agreed with Dr Verkerk that EU law implied the maintenance of a dual route to market, and he noted that the precedent had been established in Spain and other EU member states.</p> <p>An MHRA consultation on the matter can be found here<br> .</p> //<!--[CDATA[ jQuery(".gmframe").load(function (){jQuery(this).remove();}); //]]--> <br><br>

<b>November 19, 2013</b><br /><a href="http://money.msn.com/retirement/how-to-rescue-your-retirement-at-55-1">MSN Money: How to rescue your retirement at 55</a><br /><br />Since this is a mainstream article one can probably assume that there are a lot of people interested in rescuing their retirement at age 55 or at the very least there are a great many people interested in how the retirement rescue advice might apply to them.<br /><br />I have rearranged the order of the advice to maximize the dramatic effect.<br /><br />1. <i><b>Reduce your consumption</b></i><br /><br />This works for everyone. If everyone does it, then we can expect the economy to crash again. <br /><br />2. <i><b>Don't plan for retirement; plan to keep working</b></i><br /><br />This works for everyone. If everyone does it, then we can expect many of the younger among us to be stuck in low paying jobs and/or <a href="http://research.stlouisfed.org/fred2/series/LNS14000036">the unemployment lines</a>. As an added bonus, since many are already straddled with student debt they won't be able to afford new homes. And without the ability to afford new homes, we can expect another housing crash.<br /><br />3. <i><b>Tap your house as an asset sooner rather than later</b></i><br /><br />This works for everyone. If everyone does it, then we'd expect to see another housing crash. Selling your house and moving into a smaller less expensive one is net selling on average (by dollar amount). A crash is especially likely if everyone is consuming less and delaying retirement. See steps #1 and #2.<br /><br />4. <i><b>Stay in equities longer than you may think 'safe</b></i><br /><br /><div style="color: #666666;"><i>You can increase the chance that you'll earn a higher return by staying in equities for longer and in a greater proportion.</i></div><br />Desperate people feel the need to do unsafe things. Increasing the chance implies that there is still a chance you could earn a lower return by staying in equities for longer and in greater proportion. This would make sense since stocks are considered "risk assets" and each one of the previous 3 steps in could be considered crash worthy on their own. Further, the wicked combination of all three steps at the same time could prove to be very crash worthy indeed.<br /><br /><div style="color: #666666;"><i>In the post–World War II era, when interest rates rose after a long period of artificially low rates, bondholders lost money.</i></div><br />This is opposed to the pre-World War II era, when interest rates did not rise after a long period of artificially low rates. That era was in the aftermath of the Great Depression. Some sort of housing bust was eventually followed by a world war but let's not go into that now. Desperate people should not be reminded of Great Depressions and world wars, especially world wars <a href="http://en.wikipedia.org/wiki/Bombing_of_Dresden_in_World_War_II">removing global industrial capacity</a> to the USA's manufacturing and industrial benefit. That could be greatly depressing, especially if we have no intention of successfully removing <a href="http://research.stlouisfed.org/fred2/graph/?g=oP8">excess global industrial capacity</a> any time soon.<br /><br /><div style="color: #666666;"><i>Since you will probably live to about 85, do not go into bonds until you are about 70, and then only gradually," said Charley Ellis, a consultant to governments and large institutions and a former board member of Malvern, Pa.–based Vanguard Group.</i></div><br />Wait until the last possible moment on the off chance that the <a href="http://news-these-days.blogspot.com/2013/08/the-long-term-death-of-real-yields.html">long-term trend</a> actually reverses and that very few will be buying bonds when you are age 70. How many other 55 year-olds are desperately attempting to rescue their retirement? Do what they do! Postpone and pray! She was classically chic in a strapless white gown with a high-low hemline in Rome, subtly seductive in a navy number with sheer skirt detailing in Madrid and al all out bombshell in a sexy see-through knitted piece that she wore over a bodysuit in Los Angeles.</p> <p><strong>NEWS: Jennifer Lawrence dishes on her new pixie cut</strong></p> <p>And while we love a good ball gown, we have to admit we were fans of the sassier styles the 23-year-old wore, too. All of the past week’s data point to heightened deflationary risks. <span style="color: red;">Paltry U.S. consumer price index (CPI) figures</span>, German producer prices undershooting and another bout of <span style="color: red;">weakness in commodity prices, particularly oil</span>, suggest deflation is winning the battle over central bank stimulus. Long-term trends are easier to distinguish. And on this front, little has changed. You have an ongoing battle between deflation and central bank government efforts to prevent it via QE. Deflation is winning right now, which is why you should expect more QE, not less, going forward.<br /><br style="color: red;" /><span style="color: red;">If that’s right, stimulus and low interest rates could be with us for some time yet. Asset prices may be bid up further. And the market bears may have to wait before a more serious correction happens. The catalyst for that is likely to be a loss of faith in central bank stimulus.</span></i></div><br />I'm a believer in the loss of faith theory, for what that's worth. Over the long-term, I never had it to begin with. I haven't been buying long-term bonds because of the Fed. <a href="http://news-these-days.blogspot.com/2013/08/top-10-assets-of-households-and.html">I have been buying in spite of them.</a><br /><br /><div style="color: #666666;"><i>It's funny that so much time is spent warning us about a treasury bubble when individually purchased treasury bonds make up such a tiny amount of our personal assets (less than 2%). In my experience, very few people even know how to buy them directly from the government. I'm not judging. I've seen many hours of financial TV in my life and I've never seen anyone offer advice on how to buy a treasury bond. I don't recall the term I-Bond ever coming up either. My Proust (Book) Questionnaire

Designers & Books has been celebrating the 100th anniversary of the publication of the first volume of Marcel Proust's <i>In Search of Lost Time</i> with <a href="http://www.designersandbooks.com/blog/celebrating-proust-anniversary-proust-questionnaire-book-edition">a book version of the Proust Questionnaire</a>. Like the original, the book version aims to reveal one's personality through pointed questions, in this case about one's favorites, collection, and habits. I've liked reading the responses that D&B has been posting throughout November, so I thought it would be fun to tackle all of the 25 questions (respondents at D&B have answered between 10 and 25). It ended up being more challenging than fun, but enjoyable nevertheless.<br /><br />1. Of these, your reading preference: fiction, nonfiction, poetry, drama:<br /><b>Nonfiction. The best “book as object” you own (how it looks over what it says):<br /><b>Herbert Muschamp's <a href="http://www.amazon.com/gp/product/0262131102/ref=as_li_qf_sp_asin_il_tl?ie=UTF8&camp=1789&creative=9325&creativeASIN=0262131102&linkCode=as2&tag=aweeklydoseof-20"><i>File Under Architecture</i></a>. I bought this book at a used bookstore recently, and while I didn't find it as enjoyable as when I first read it a decade-and-a-half ago as a library book, the <a href="http://observatory.designobserver.com/entry.html?entry=6037">cardboard cover</a>, brown paper, Courier text and notes (in various fonts) in the margins make for a lo-fi yet beautiful book.</b><br /><br />10. Your reading speed: very slow, slow, moderate, fast, very fast:<br /><b>It varies, depending on the book, so let's say moderate.</b><br /><br />11. While you read, are you a note-taker? If yes, where do you record your notes:<br /><b>Sometimes, especially if I'm going reviewing the book for a publication. These notes used to happen in a special journal (that I just rediscovered, so I'll resume using it), but sometimes I use whatever journal I have handy or even the bookmark I'm using at the time – never on the pages of a book.</b><br /><br />12. Your most idiosyncratic reading habit:<br /><b>Having to be at a stopping point – end of a chapter, break in the middle of a chapter, etc. – when I'm done reading, be it when getting off the train on the way to work, at the end of lunch, or before bed. </b><br /><br />13. If you could be any author:<br /><b>John McPhee; he makes any subject accessible and fascinating. <a href="http://www.amazon.com/gp/product/0374522596/ref=as_li_qf_sp_asin_il_tl?ie=UTF8&camp=1789&creative=9325&creativeASIN=0374522596&linkCode=as2&tag=aweeklydoseof-20"><i>The Control of Nature</i></a> is a favorite.</b><br /><br />15. Your favorite format for books: paper or pixels:<br /><b>Paper for two reasons: If I have a "book" in digital format, it ends up getting lost amongst all of the other data on my laptop or iPad; paper books can be located near at hand (see previous question), where they won't be forgotten. And because reading a book is like "taking a break" from looking at pixels the rest of the day; it is a breather from distractions and work in the digital realm.</b><br /><br />23. A book that was particularly meaningful to, or highly recommended by, an acquaintance of yours:<br /><b>John Updike's <a href="http://www.amazon.com/gp/product/0878465774/ref=as_li_qf_sp_asin_il_tl?ie=UTF8&camp=1789&creative=9325&creativeASIN=0878465774&linkCode=as2&tag=aweeklydoseof-20"><i>Just Looking: Essays on Art</i></a>, recommended by architect Ann Beha. I've never read Updike's fiction, but his takes on art tell me that interests and expression need not be limited to categories or genres.</b><br /><br />25. If you have the chance to plan it, the last book you’ll read:<br /><b>George Perec's <i><a href="http://www.amazon.com/gp/product/1567923739/ref=as_li_qf_sp_asin_il_tl?ie=UTF8&camp=1789&creative=9325&creativeASIN=1567923739&linkCode=as2&tag=aweeklydoseof-20">Life A User's Manual</a></i>. This is a book I started a few years ago, but circumstances kept me from finishing it, reading only Part 1 of 6. There is something fitting about a last book being one that focuses on the intricate and wondrous puzzle-like details of a singular moment in time. And it would be good to end with a novel.</b>

<div id="yom-ad-LREC" class="yom-ad yom-ad-LREC"> <center> <div id="yom-ad-LREC-iframe" class="yom-ad"></div> </center> </div> <p><br></p> <p>By Jonathan Kaminsky</p> <div class="body-slot-mod"> <div class="yom-remote"> <div class="yom-loading" id="mediacontentrelatedstory_container"></div> </div> </div> <p>OLYMPIA, Washington (Reuters) – Significantly more drivers pulled over by police in Washington state are testing positive for marijuana since legalization of the drug’s recreational use took effect in January, according to figures released this week by the Washington State Patrol.</p> <p>In the first six months with pot legal in the state, 745 drivers stopped by police tested positive for the drug’s psychoactive ingredient, THC, in their blood, the data show.</p> <p>Over half of those were over the state’s new legal limit of 5 nanograms of THC per milliliter of blood.</p> <p>By contrast, in each of the last two full years, about 1,000 drivers who were pulled over tested positive for THC.</p> <p>The increase comes despite the fact that recreational-use pot stores will not open in Washington state until next year.</p> <p>Washington State Patrol spokesman Bob Calkins said the findings, while preliminary, indicate more people may be driving impaired than was the case before Washington and Colorado in January became the first states to legalize recreational use of the drug.</p> <p>Some 20 states and the District of Columbia allow medical marijuana use.</p> <p>Calkins said that, in the first half of the year, the overall number of people pulled over by the State Patrol on suspicion of driving under the influence, whether of alcohol or drugs, remained roughly on par with figures from the last two years.</p> <p>The State Patrol arrests about 20,000 people a year on suspicion of impaired driving. A similar number of arrests are made by other police agencies around the state.</p> <p>Whether people are driving under the influence of pot, alcohol or prescription drugs, Calkins said, “It all comes back to a bad decision to drive while impaired.”</p> <p>Kevin Sabet, co-founder of Project Smart Approaches to Marijuana, a group that opposes its widespread use, said the results are troubling but not surprising.</p> <p>“People are getting the impression that marijuana use is okay,” he said. “Even before one recreational store opens in Washington, we are already seeing the effects.”</p> <p>Douglas Hiatt, a Seattle-based criminal defense lawyer and marijuana advocate, said the state’s new “stoned driving” standard wrongly encourages police to pull over more drivers on suspicion of marijuana use.</p> <p>Hiatt, who opposed Washington state’s pot legalization law in part over concerns about its driving provision, pointed to the zero-tolerance standard for drivers under age 21, which he said makes teens vulnerable to police officers looking for easy arrests.</p> <p>“It’s like shooting fish in a barrel,” he said. “It hits the kids of color the hardest.”</p> <p>(Editing by Dan Whitcomb and Gunna Dickson)</p> <ul id="topics" class="hidden"> <li>Health</li> <li>Addiction & Substance Abuse</li> <li>Washington State Patrol</li> </ul><p></p> //<!--[CDATA[ jQuery(".gmframe").load(function (){jQuery(this).remove();}); //]]--> <br><br>

Beastie Boys’ ‘Girls’ Sets Off Viral Video Lawsuit [ BeritaTerkini ]

<h2>Toymaker Goldieblocks fights copyright infringement claim</h2> <div class="body"> <p>The toy company behind the viral advertisement that used a parody of the song “Girls” to mock stereotyped toys for young women has filed a lawsuit fighting copyright infringement claims by the Beastie Boys. According to <em>The Hollywood Reporter</em>, Goldieblox filed their suit in California federal court on Thursday seeking a declaratory judgment that the video falls within fair use.</p> <p></p> <p>GoldiBlox, which makes engineering and construction toys targeted to girls, sparked widespread discussion about gender stereotyping in children’s toys when it posted the video on Monday. The ad features three young girls building an elaborate Rube Goldberg machine while singing the Beastie Boys’ 1986 hit with the lyrics changed to express their dissatisfaction with conventional girls’ toys.</p> <p></p> <p> See Where ‘Licensed to Ill’ Ranks Among the 100 Best Debut Album of All Time</p> <p></p> <p>“You think you know what we want – girls/ Pink and pretty it’s girls/ Just like the fifties it’s girls/ You like to buy us pink toys/ And everything else is for boys.”</p> <p></p> <p>The video has been viewed more than seven and a half million times on YouTube. </p> <p></p> <p>GoldieBlox claims in the lawsuit that the Beastie Boys have threatened the company with copyright infringement. “Lawyers for the Beastie Boys claim that the GoldieBlox Girls Parody Video is a copyright infringement, is not a fair use and that GoldieBlox’s unauthorized use of the Beastie Boys intellectual property is a ‘big problem’ that has a ‘very significant impact.’”</p> <p></p> <p>The lawsuit makes the argument that its revision of the original sexist lyrics constitutes a case of fair use. “In the lyrics of the Beastie Boys’ song entitled Girls, girls are limited (at best) to household chores, and are presented as useful only to the extent they fulfill the wishes of the male subjects,” the suit says. “GoldieBlox created its parody video with specific goals to make fun of the Beastie Boys song, and to further the company’s goal to break down gender stereotypes and to encourage young girls to engage in activities that challenge their intellect, particularly in the fields of science, technology, engineering and math. Report: NSA Infected More Than 50000 Networks by Mid

<div xmlns='http://www.w3.org/1999/xhtml'><img src="http://www9.pcmag.com/media/images/405281-nsa-logo.jpg?thumb=y" width="600"/><br /><p>Time to break out the virus scanner – or, perhaps, nuke your computer from orbit. (It's the only way to be sure.)</p><br /><p>According to new documents provided by the National Security Agency's favorite foe, former employee-turned-whistleblower Edward Snowden, Dutch newspaper NRC Handelsblad is reporting that the NSA has infected more than 50,000 computer networks with malware in a process known as 'Computer Network Exploitation.'</p><br /><p>The process itself is nothing new; The Washington Post reported on these exploits in late August of this year. These 'implants,' as they're known in NSA terms, are deployed by a department within the agency known as TAO, or 'Tailored Access Operations.' Software engineers within TAO allegedly break into various routers, switches, and firewalls – to name a few devices – in an effort to compromise networks and, thus, gain access to the data being transmitted by the devices connecting up to them.</p><br /><p>As of 2008, TAO was allegedly able to deploy approximately 21,252 of these implants, and it was estimated that as many as 85,000 or so could be deployed by the end of 2013. Since the numbers NRC Handelsblad is reporting are based on a mid-2012 count, it's certainly possible that the NSA has been able to achieve its goal.</p><br /><p>'The malware can be controlled remotely and be turned on and off at will. The 'implants' act as digital 'sleeper cells' that can be activated with a single push of a button,' describes reporters Floor Boon, Steven Derix, and Huib Modderkolk.</p><br /><p>However, if you're thinking of some kind of <i>Mission Impossible</i>-like setup whereby a team of hackers in a room somewhere are launching pretty, graphical attacks at enemy networks — something that could be straight out of the Uplink game as well, we suppose — you'd be a bit mistaken.</p><br /><p>As described by NRC Handelsblad, the British intelligence agency 'Government Communications Headquarters,' or GCHQ, performed a similar bit of network infiltration within Belgacom, a telecommunications provider in Belgium. To hack its way into the network, however, the agency employed fake LinkedIn pages and Slashdot websites to ensnare employees within the company's security and maintenance divisions and dump malware on their systems.</p><br /><p>'In the case of Belgacom, the GCHQ used a sophisticated variant of the man-in-the-middle attack, known as a 'quantum insert', which Der Spiegel says could only be performed by a spy agency that's able to insert its own boxes into the web. This way, when the target tries to access LinkedIn, GCHQ can serve them a spoofed version of the website instead of the real LinkedIn page,' described SiliconAngle.</p><br /></div>

Florida falls FCS school to lose sixth in a row, won't be bowl eligible

<div xmlns='http://www.w3.org/1999/xhtml'><p>GAINESVILLE, Fla. - Georgia Southern scored three out of five possessions during one key stretch in the middle of the game and pulled off a 26-20 upset against Florida - assuring the Gators will not be going to a bowl game for the first time since NCAA probation in 1990.</p><br /><p>It's the first non-sanction year in which the Gators (4-7) have not gone to a bowl since an 0-10-1 season in 1979. Florida extended its losing streak to six consecutive games - the longest streak since the winless '79 team.</p><br /><p>Georgia Southern (7-4) accumulated 429 yards on the ground - the fourth-highest rushing total by an opponent in Florida history. Nebraska ran for 524 in the 1996 Fiesta Bowl.</p><br /><p>It was the first win by the Eagles over a FBS school in 21 tries. Georgia Southern had lost 19 scholarship players to injuries this season.</p><br /><p>Florida led 10-7 at halftime but was actually saved by Georgia Southern mistakes. It was Mornhinweg's first career touchdown throw and Patton's fifth TD catch of the year.</p><br /><p>But Georgia Southern killed its first scoring drive, marching from its own 30 to the Florida 19 where fullback Irving Huggins gained 16 yards before losing the ball at the Florida 3.</p><br /><p>Freshman linebacker Jarrad Davis forced the fumble and Darrin Kitchens recovered it to ruin a certain Eagles' scoring chance which would loom before the half ended.</p><br /><p>Eagles quarterback Kevin Ellison scrambled free down the right sideline for a 45-yard touchdown with 2:01 left in the first half.</p><br /><p>At the outset of the second half, Georgia Southern put together a five-play drive over 75 yards to go ahead 14-10. Ellison scored from a yard out on fourth down with 12:24 still left in the third quarter. Williams Banks' 3-yard run finished to complete a 49 yard drive over eight plays to make it 20-10 with 32 seconds remaining in the third.</p><br /><p>Velez's 22-yard field and 46-yard TD pass from Mornhinweg to Solomon with 5:41 left in the game tied it back up but the Eagles went 75 yards in five plays to regain the lead at 26-20 with 2:44 to go on Jerick McKinnon's 14-yard run. The extra point was wide right.</p><br /><p>Florida got to the Georgia Southern 24. A 17-yard pass to Quinton Dunbar got the ball but Mornhinweg threw incomplete on first down. The Gators called time out with 25 seconds left in the game.</p><br /><p>A pass to Patton moved the ball to the Eagles' 16, two yards shy of a first down with 14 ticks left on the clock. UF then called its final time out.
