Right-to-work-for-less amendment fails in Senate

<span style="font-family: inherit;">Two of Congress’s most reliably anti-worker senators have a simple message for American workers: Love whoever you want, just don’t love unions.</span><br /><br /><div>Kentucky Sens. <a href="http://www.sourcewatch.org/index.php/Mitch_McConnell" rel="nofollow">Mitch McConnell</a> and <a href="http://www.sourcewatch.org/index.php/Rand_Paul" rel="nofollow">Rand Paul</a> proposed to make an anti-discrimination bill more discriminatory by <a href="http://www3.blogs.rollcall.com/wgdb/mcconnell-paul-want-right-to-work-law-on-enda/" rel="nofollow">attaching a national right-to-work-for-less law to the legislation</a>.<br /><br />If enacted, the <a href="http://en.wikipedia.org/wiki/Employment_Non-Discrimination_Act" rel="nofollow">Employment Non-Discrimination Act</a> (ENDA) would outlaw workplace discrimination based on sexual orientation and identity. For McConnell and Paul, that’s a small price to pay in exchange for a national <a href="http://s4.epi.org/files/2012/RTW-101.pdf" rel="nofollow">right-to-work-for-less law</a>, which would effectively kill freedom in the workplace by crippling unions across the country. <br /><br />Fortunately, the Senate passed the Employment Non-Discrimination Act Thursday afternoon without the McConnell-Paul attack on workers. But let's take a moment to dissect exactly what they were trying to do.<br /><br />The <a href="http://www.huffingtonpost.com/2013/11/05/mitch-mcconnell-rand-paul-right-to-work_n_4219341.html?utm_hp_ref=politics" rel="nofollow"><em>Huffington Post</em> reports</a>:</div><blockquote class="tr_bq">The measure would forbid contracts between companies and labor unions that require workers to pay the union for bargaining on their behalf. Prized by Republicans and business groups and loathed by unions, such laws have made it onto the books in 24 states, most recently in Michigan.</blockquote><blockquote class="tr_bq">Speaking on the Senate floor Tuesday, McConnell praised Michigan Gov. Rick Snyder (R), who signed the state law in December after it was fast-tracked through the Republican-controlled legislature. McConnell said he and Paul were following Snyder's lead. </blockquote><div>Funny how two guys – Rand Paul especially – who think government is bad suddenly think government is a good tool for interfering with unions' ability to function and shrinking the middle class.<br /><br />That’s exactly what right-to-work-for-less laws aim to accomplish. When McConnell says he wants to diminish the power of “Big Labor,” he wants us to forget that that he’s doing the bidding of billionaires and corporate CEOs determined to expand profits by exploiting workers.<br /><br />The only kind of freedom that “right to work” laws promote is the freedom of corporations to ship more jobs overseas and treat workers as disposable objects with no rights worthy of the boss’s respect. Unions are the only force standing in the way of Wall Street and its dream of a world where workers are voiceless and impoverished.<br /><br />Hence McConnell and Paul’s cynical ploy to tack a national “right to work” amendment on to a bill that’s supposed to <em>eliminate</em> discrimination in the workplace.<br /><br />The bill now heads to the House of Representatives. Earlier this week, <a href="http://teamster.org/" rel="nofollow">Teamsters</a> General President Jim Hoffa urged the members of Congress to <a href="http://www.teamster.org/content/teamsters-urge-passage-employment-non-discrimination-act">look in their hearts</a> and move ENDA legislation forward, as the Senate has:</div><blockquote class="tr_bq">Workers for more than a century have joined forces to protect each other from intolerance and favoritism. We support ENDA because we stand for fair treatment of all workers, as we always have. Workers cannot be divided for any reason, whether it be race, religion, ethnicity, gender or any other basis.</blockquote><div>Dividing workers is exactly what McConnell and Paul were trying to do. And it shows how serious these corporate flunkies are about quashing freedom and America’s middle class. </div>

Even 61 percent of <i>Republican women</i> don't want to see Republicans go through with such a plan.<br /><br />For those who were not paying attention in 1995 when the GOP <a href="http://www.huffingtonpost.com/2011/03/30/voters-blamed-gop-for-1995-shutdown_n_842769.html">shut down the government</a>, it wasn't pretty. Google it. Or listen to the voices of experiences who have been there and done that, like Senator Saxby Chambliss, 69, and Joe Scarborough who was a congressman at the time.<br /><br />Now a poll, commissioned by Republicans, is confirming that a shutdown will not bode well for the GOP. Will those "show horses" of the U.S. Senate, as the <a href="http://www.nytimes.com/2013/08/01/opinion/collins-politics-of-a-screeching-halt.html?_r=1&"><i>New York Times</i></a> called Rand Paul of Kentucky, Ted Cruz of Texas, and Marco Rubio of Florida, continue to push for it?<br /><br />Byron York, like others, can look at this poll and read the tea leaves:<br /><blockquote>"But there is no doubt defunding advocates anticipate a possible shutdown; their hope is to persuade the public to blame President Obama, and not Republicans, for it. The new numbers suggest they will have a lot of persuading to do."</blockquote>It brings to mind once again American philosopher George Santayana's much-quoted belief, "Those who forget the past are doomed to repeat it." Hopefully, GOP leadership and experienced voices will be able to stop the proposed fallacy.

It took years to regain the confidence of the American people who blamed Republicans for the shutdown. Indeed, <a href="http://tv.msnbc.com/2013/07/31/saxby-chambliss-good-hustle-tea-party-but-government-shutdowns-dont-work/"><i>Morning Joe</i></a> host Joe Scarborough was a Florida Congressman during the 1995 shutdown. He learned from that experience and called the current  threat "one of the stupidest arguments he's heard in two decades":<br /><blockquote>“We’ve got a president that’s gonna celebrate Republicans making the same mistake back when we shut down the government and basically re-elected Bill Clinton,” Scarborough said.</blockquote>The new breed of Republicans could learn from the experience and wisdom of those who have walked before them. But listening to Cruz, that doesn't seem likely:<br /><blockquote>“The sort of cocktail chatter wisdom that ‘Oh, the shutdown was a disaster for Republicans’ is not borne out by the data,” Cruz said.</blockquote>Meanwhile, the other side of the political aisle is watching this unfold, as Collins writes: <br /><blockquote>The Democrats are sort of horrified and sort of enthralled by the whole drama.<br /><br />“Give a call to Newt Gingrich. He’ll return your phone calls. Mitch McConnell’s 2014 re-election race. “Senator Paul is one of those leaders, and the list of others is short.”</div><div style="border: 0px; font-family: georgia; font-size: 15px; line-height: 1.5em; outline: 0px; padding: 0px 0px 22px; vertical-align: baseline;">While the issue Paul chose — drones and, specifically, the possibility of strikes against American citizens in the U.S. — isn’t a high-profile one, it became clear as the Kentucky Republican talked (and talked) that he was creating a major moment for a party that hasn’t had very many of those since Nov. 6, 2012.</div><div style="border: 0px; font-family: georgia; font-size: 15px; line-height: 1.5em; outline: 0px; padding: 0px 0px 22px; vertical-align: baseline;">“It was one of the first examples in a long time of messaging that made the base feel like we had control of the day,” said Rick Wilson, a Florida-based Republican strategist. “Rand Paul’s stock price rose sharply today, and being the guy who set Obama on his heels — even for a day — will pay dividends for Paul in the short term, at least.”</div><div style="border: 0px; font-family: georgia; font-size: 15px; line-height: 1.5em; outline: 0px; padding: 0px 0px 22px; vertical-align: baseline;">Need evidence that Paul’s filibuster was paying political dividends?  Florida Sen. Marco Rubio — a frontrunner for the 2016 GOP presidential nod — joined Paul on the Senate floor in both a symbolic show of support, and an acknowledgment of the power of the moment his colleague had created.</div><div style="border: 0px; font-family: georgia; font-size: 15px; line-height: 1.5em; outline: 0px; padding: 0px 0px 22px; vertical-align: baseline;">By the time the 2016 Republican presidential race rolls around, the Paul filibuster will be a distant memory — even to the grassroots of the party. But, the motivation behind the filibuster — a combination of genuine conviction and a sense for the dramatic — will still burn strongly in Paul.</div><div style="border: 0px; font-family: georgia; font-size: 15px; line-height: 1.5em; outline: 0px; padding: 0px 0px 22px; vertical-align: baseline;">It’s why we continue to believe no one should underestimate Paul’s ability to have a major impact on the 2016 race.
