Teamsters score major victory over sleep apnea guidance

Here's good news for Teamster truck drivers and anyone who turns a key for a living: <a href="http://www.teamster.org/" rel="nofollow">Teamsters </a>who might be at risk for <a href="http://en.wikipedia.org/wiki/Sleep_apnea" rel="nofollow">sleep apnea</a> won't have to undergo costly tests or lose time at work because of federal regulators.  The International Brotherhood of Teamsters successfully lobbied Congress to force<a href="http://fmcsa.dot.gov/" rel="nofollow"> federal trucking regulators</a> to set strict guidelines for when they can require screening, testing and treatment for sleep apnea.<br /><br />The House and Senate passed the bill unanimously, and President Obama signed it into law earlier this week. Now, federal regulators will have to listen to the Teamsters, owner-operators, trucking and bus associations and YOU before issuing regulations on sleep apnea.<br /><br />This is a good thing because regulators were coming up with "guidance" for testing and treating sleep apnea for truckers and other CDL holders. That "guidance" could have cost commercial truck drivers thousands of dollars in out-of-pocket expenses. It could have cost them their jobs.<br /><br />The Federal Motor Carrier Safety Administration (FMCSA) actually stated that 28 percent of CDL holders have sleep apnea. FMCSA's guidance in 2012 set arbitrary standards -- like 17-inch necks and certain body mass indexes -- that would have forced many Teamsters to go through the potentially costly testing.<br /><blockquote class="tr_bq"> Teamsters General President <a href="http://www.teamster.org/content/james-p-hoffa">James P. Hoffa</a> said in a <a href="http://www.teamster.org/content/teamsters-stop-fmcsa-attack-truck-drivers" rel="nofollow">statement</a>, We cannot allow federal regulators to make uninformed decisions that will cost millions of people a lot of money that they can’t afford to spend right now... </blockquote><blockquote class="tr_bq">This law, which passed the House with a unanimous vote, protects millions of working men and women who turn a key for a living from being forced to spend money on a test they may not need at the whim of a federal agency.</blockquote>The new law won't absolutely prevent doctors from referring certain drivers for testing during their medical exams, it will postpone mandatory screening for three years or more.  During that time, you can be sure the Teamsters' voices will be heard!<br />

Because, as the website points out, members of Congress were found <a href="http://www.salon.com/2013/10/01/grayson_blames_shutdown_on_gop_literally_drinking_on_the_job/" rel="nofollow">boozing up</a> right after they shut down the government and put 800,000 people out of work:<br /><blockquote class="tr_bq">As Members of Congress quickly returned from their final symbolic, non-effective and otherwise useless votes to avert a government shutdown, the heavy drinking began. Reports of our representatives getting plastered on the government's dime -- the one we have left -- have come streaming in from witnesses all over Capitol Hill.  </blockquote> </span><span style="font-family: inherit;">And you certainly don’t have to be a furloughed government worker to be pissed off at Congress. Other workers from <a href="http://www.seiu.org/" rel="nofollow">SEIU</a>, the <a href="http://teamster.org/" rel="nofollow">Teamsters</a> and <a href="http://goodjobsnation.org/" rel="nofollow">Good Jobs Nation</a> came out to support their union brothers and sisters.<br /><br />Rain pounded down on a furloughed aviation inspector who spoke to protesters:<br /><blockquote class="tr_bq">I'm a little damp right now, but that's nothing compared to the way American workers are getting soaked by House Republicans.</blockquote>Rev. Jesse Jackson, union leaders and dozens of members of Congress also rallied the crowd. Like a <a href="http://teamsternation.blogspot.com/2013/10/hundreds-rally-against-shutdown.html">similar protest held last week</a>, Rep. Keith Ellison (D-Minn.) of the Progressive Caucus led the demonstration, joined by Alan Grayson (D-Fla.) and Nancy Pelosi.<br /><br />Workers chanted "Let us work," holding umbrellas and signs that said "Stop the lockout" and "Stop holding America hostage."<br /><br />One AFGE leader set the record straight on what American workers are willing to negotiate on with anti-worker Republicans:<br /><blockquote class="tr_bq">Half of our members are out of work and the other half are being forced to work without a paycheck. And despite what John Boehner and tea party extremists are saying, we are willing to negotiate. We want to negotiate an end to sequestration and a fairer tax system so that the rich and corporations pay their fair share. </blockquote><blockquote class="tr_bq">We have all kinds of ideas to end the plight of the working class and improve federal government. But we don't shut down the government to make a political point.</blockquote>As always, Sen. Bernie Sanders (I-Vt.) called out the extremists in Congress and put their latest attack on the middle class in context:<br /><blockquote class="tr_bq">This shutdown started with tea party hostage-takers wanting to stop health care reform. But let's be clear: destroying health care is just the tip of the iceberg for right-wing extremists. They want to destroy Social Security and Medicare. They want to end regulations on Wall Street. They want to go after the whole social safety net that keeps millions of Americans from falling into extreme poverty. They want an oligarchic society ruled by the rich.</blockquote><blockquote class="tr_bq">And they say they are willing to negotiate -- it's time to compromise. We have already compromised! The budget we passed is <em>their</em> budget. We don't like it. And still they want to take more from the American people.</blockquote>Today the shutdown hit <a href="http://www.politico.com/story/2013/10/nuclear-regulator-furloughing-staff-a-day-sooner-than-expected-98093.html" rel="nofollow">3,600 employees at the Nuclear Regulatory Commission</a> -- the people who make sure a Fukushima-like nuclear disaster doesn't happen in America. Meanwhile the clock is ticking on the deadline to increase the debt ceiling. <br /><br />The shutdown has hurt hundreds of thousands of workers, families and small businesses, but millions more will face a deep economic crisis if Congress drives the government to default. <br /><br />Some locked-out government workers said they will <a href="http://www.dclabor.org/ht/display/EventDetails/i/111831/pid/538" rel="nofollow">return to the Capitol tomorrow</a> -- rain or shine -- to keep the pressure on politicians and stop Republicans' war on working families.

Stunning news was delivered today on the floor of the U.S. House of Representatives by Virginia Congressman Frank Wolf (R-10th District) who had questioned earlier this week why no survivors of the Benghazi, Libya, terrorist attack had testified publicly before Congress. <br /><br />The September 11, 2012, attack on the American Embassy resulted in the deaths of four Americans including U.S. Ambassador Christopher Stevens, U.S. Foreign Service Information Officer Sean Smith, and two embassy security officers who were former U.S. Navy Seals, Tyrone Woods and Glen Doherty. Questions have been raised with some allegations the White House tried to cover up what happened that night.<br /><br />The <a href="http://www.weeklystandard.com/blogs/congressman-benghazi-survivors-forced-sign-non-disclosure-agreements_739975.html">Weekly Standard</a> reported Wolf's remarks from the floor of the House as he revealed the answer to his question:<br /><blockquote>"According to trusted sources that have contacted my office, many if not all of the survivors of the Benghazi attacks along with others at the Department of Defense, the CIA have been asked or directed to sign additional non-disclosure agreements about their involvement in the Benghazi attacks. Some of these new NDAs, as they call them, I have been told were signed as recently as this summer."</blockquote>He went on to say:<br /><blockquote>"If these reports are accurate, this would be a stunning revelation to any member of Congress, any member of Congress that finds this out and also more importantly to the American people. It also raises serious concerns about the priority of the administration's efforts to silence those with knowledge of the Benghazi attack in response."</blockquote>Wolf said he supported a Select Committee, along with 159 of his colleagues, to learn what happened the night of September 11, 2012, in Benghazi.<br />
