Someone please explain to me how someone can be arrested,convicted, fined or sentenced for a crime that doesn't exist?<br /><br /><br />In the knee jerk reaction to the Sandy Hook shooting last year, there were a plethora of new , restrictive, gun laws passed because as we all know, politicians always feel the need to "do something" after any kind of tragedy.<br /><br />New York went over the top and passed some of the most restrictive gun laws in the country that basically outlawed items that were perfectly legal to own before the laws were passed and thus put an onerous burden on citizens to get rid of certain guns and magazines before a certain date.<br /><br />Some parts of those laws have not taken effect yet and won't until January, 2014.<br /><b><br />By<a href="http://connect.syracuse.com/staff/teweaver/posts.html"> Teri Weaver | tweaver@syracuse.com </a></b><br /><blockquote>The NY Safe Act passed in early January in the wake of the Sandy Hook Elementary School shootings in Newtown, Conn. At the time, supporters of the new laws praised the changes as among the toughest gun restrictions in the nation.<br /><br />The act changed or added to at least 15 different facets of state law, according to the New York State Police's guide to its troopers.<br /><br />The act famously banned "assault weapons," semi-automatic guns with a detachable magazine that have extra components such as a pistol grip, flash suppressor or folding stock. People who owned these guns before Gov. Andrew Cuomo signed the act on Jan. 14 have until April 15, 2014 to register them with the state.</blockquote>snip<br /><br /><blockquote>Syracuse, N.Y. -Nearly 1,000 people have been charged under the NY Safe Act in the eight months since the tougher gun control law was passed, according to the state's Division of Criminal Justice Services.<br /><br />Nearly 90 percent were accused of a crime that pre-dates the new act - including having a sawed-off long gun or an unregistered pistol - but was elevated to a felony when the Safe Act went on the books Jan. 15.<br /><br />The arrests dealing with the more controversial portions of the Safe Act, including possession of a large capacity magazine or a newly defined "assault weapon," are far fewer. And it's unclear whether some of those charges will actually stick, in part because gun owners still have time to register or get rid of certain guns and large-capacity magazines.<br /><br />Take, for example, possession of a magazine that holds more than 10 rounds.<br /><br />Across the state, 20 people have been charged with this misdemeanor, according to data The Post-Standard and Syracuse Media Group requested from DCJS. That includes three people in Onondaga County, according to the stats.<br /><br />But the New York State Police advises its troopers that this change in the law isn't actually enforceable until Jan. 15. Dan Feldman, a former state lawmaker who now teaches at John Jay College of Criminal Justice, agrees.<br /><br />Others interpret that part of the law differently. Certain large capacity magazines are now unlawful under the Safe Act, though owners have until Jan. 15 to get rid of them. <div id="yom-ad-LREC" class="yom-ad yom-ad-LREC">  <center>  <div id="yom-ad-LREC-iframe" class="yom-ad"></div>  </center>  </div>  <p><br></p>  <p>By Steve Norder</p>  <div class="body-slot-mod">  <div class="yom-remote">  <div class="yom-loading" id="mediacontentrelatedstory_container"></div>  </div>  </div>  <p>GAINESVILLE, Georgia (Reuters) – Republicans went to the American South on Monday to press their opposition to President Barack Obama’s signature healthcare law in a U.S. congressional hearing that the law’s supporters called a one-sided political attack.</p>  <p>The hearing, chaired by Republican Representative Rob Woodall of Georgia, heard from witnesses picked by the panel’s Republicans who said that the healthcare law – intended to help millions of uninsured and under-insured people get affordable medical insurance – actually will raise insurance costs and reduce coverage choices for many people in rural America.</p>  <p>Michael Boyette, a 28-year-old businessman from Ellijay, Georgia, said his insurance premium was increasing by almost $ 200 per month for his family of three.</p>  <p>“You may think that we went with a more expensive plan or have gotten more coverage,” Boyette said during the hearing, the second of four events on the Affordable Care Act to be held outside Washington by the Republican-led House of Representatives Committee on Oversight and Government Reform.</p>  <p>“In fact, we have not,” Boyette said. “We have less coverage than before, also higher out-of-pocket expense and a premium that has risen 65 percent. This is not affordable to me.”</p>  <p>Supporters of the law, also known as Obamacare, complained that the hearing was merely the latest attempt by Republicans to denigrate it.</p>  <p>Carolyn Reed-Smith said she came from Spartanburg, South Carolina, hoping to speak about the benefits of Obamacare.</p>  <p>“They gave only one side of the story and were not looking for the other side,” Reed-Smith said.</p>  <p>DeLane Adams, from the Atlanta area, had hoped to address the hearing to urge the lawmakers to press Georgia’s Republican governor, Nathan Deal, to allow the expansion of the Medicaid health insurance program for the poor in the state as permitted under Obamacare. Deal, like some other Republican governors, has declined to do so.</p>  <p>“If this was a true hearing, they should let everyone speak on both sides,” Adams said.</p>  <p>HealthCare.gov, the U.S. government’s web portal for offering private health coverage to uninsured Americans in 36 of the 50 states under Obamacare, has been at the center of a political fire storm over technical problems that overwhelmed its October 1 launch and have dogged the system ever since.</p>  <p>In addition, insurance companies have canceled millions of existing insurance policies because they do not meet the law’s standards for coverage even though Obama had promised that people happy with their insurance would be able to keep it.</p>  <p>‘STICKER SHOCK’</p>  <p>Woodall said during the hearing that many Americans are experiencing “sticker shock” as they face the cancellation of their current policies and seek new coverage under Obamacare.</p>  <p>Those new policies “cost more and cover less of those things that are most important to them,” the congressman said. “Many more are learning that their doctor isn’t available to them under their new, ‘better’ plan.”</p>  <p>Another witness called by the panel, Raymer Sales Jr., who is with a Duluth, Georgia-based firm that works with employers to develop employee healthcare plans, spoke of rising costs.</p>  <p>“The insurance community has known from the very beginning that prices were expected to increase because of the required additional benefits,” Sales said. “However, talking about the prospective increase in the cost of health insurance pales in comparison to showing someone real numbers.”</p>  <p>The first of the committee’s field hearings was last Friday in North Carolina. The panel’s chairman, Representative Darrell Issa of California, attended that one but skipped Monday’s hearing. After a few months, she sent me something disturbing.<br /><br><br /><br>It was a black-and-white scan of an article clipped from the long-goneArgus of Rockaway Beach, New York. In the scan, the type was faded and there were ragged gaps where the soft newsprint had worn through. The clipping must have been folded and carried around a long time before it was pasted back together and put away.<br /><br><br /><br>The article was about my great-uncle Joe, the youngest brother of my cousin's grandmother and my grandfather. In a family that never talked much about the past, he had been discussed even less than the rest. I knew he had been a fireman in New York City and died young, and that his death scarred his family with a grief they never recovered from. I knew that my father, a small child when his uncle died, was thought to resemble him. I also knew that when my father made his Catholic confirmation a few years afterward, he chose as his spiritual guardian the saint that his uncle had been named for: St. Joseph, the patron of a good death.<br /><br><br /><br>I had always heard Joe had been injured at work: not burned, but bruised and cut when a heavy brass hose nozzle fell on him. The article revealed what happened next. Through one of the scrapes, an infection set in. After a few days, he developed an ache in one shoulder; two days later, a fever. His wife and the neighborhood doctor struggled for two weeks to take care of him, then flagged down a taxi and drove him fifteen miles to the hospital in my grandparents' town. He was there one more week, shaking with chills and muttering through hallucinations, and then sinking into a coma as his organs failed. Desperate to save his life, the men from his firehouse lined up to give blood. Nothing worked. He was thirty when he died, in March 1938.<br /><br><br /><br>The date is important. Five years after my great-uncle's death, penicillin changed medicine forever. Infections that had been death sentences—from battlefield wounds, industrial accidents, childbirth—suddenly could be cured in a few days. So when I first read the story of his death, it lit up for me what life must have been like before antibiotics started saving us.<br /><br>Lately, though, I read it differently. And if you’re debating about whether or not you should hit the gym to make up for yesterday’s edible indiscretions, if the alternative is getting up and moving long before the sun shines for Black Friday, you may actually want to skip your run and go shopping instead — it burns more calories than you think.</p>  <p>Assuming that all you do is wander the aisles from the hours of 5 a.m. until 11 a.m. or noon, you’ll have been walking, on and off, for a total of 6 or more hours. Which, even at a very, very leisurely pace (unlikely if you’re caught up in the rush of deal-hunting), can burn around 600 calories (according to SparkPeople’s calorie estimator), depending on your size and fitness level. Add a little shivering (which burns calories) while you were waiting outside the store, plus some trying on of clothes and a bit of carrying and lifting, and you’re looking at burning as many as 1,500 calories over the course of six hours.</p>  <p>If you’re less concerned about calories, and more worried about building lean muscle, shopping can still be a physical challenge. Offer to lift, carry, and push the cart every chance you get, and throw in a few lunges and other checkout-line moves, and you’ll get a miniature resistance workout that may rival what many people put in at the gym.</p>  <p>As a general rule of thumb, skipping your workout in favor of shopping probably isn’t the wisest for your wallet or your well-being. <div class="float_left">  <div class="ad_share_box hidden">  <div id="ad_sharebox_260x60" class="ad_wrapper"></div>  </div>  </div>  <p><em>With the holiday’s fast approaching, we must remain mindful that this is a time when many experience a sense of loss and grief rather than joy. The holidays can be a lonely time and they may deny how they feel for the sake of putting on a brave face. One of the greatest gifts we can offer them is the gift of bearing witness and holding space. As a physician who has the sacred responsibility and honor to do this for my patients, I am poignantly aware of how powerful this can be. For many, it can be the greatest gift of all.</em></p>  <p>I have been seeing a patient, who I will call Ann, for 10 years. She is a therapist who is a gentle and sensitive soul. I can only imagine the gentle yet powerful space she is able to hold for her clients. As she bears witness to the many facets of their lives, they have a powerful witness to their process. They have her love, guidance, expertise and strong arms that hold them through their journeys. They are fortunate to have her in their lives. With the space she holds they know they are not alone.</p>  <p>I saw Ann the other day when she needed me to bear witness to her process. She had to hold space for a mother who had lost her daughter. She was not sure what to say to this mother to help her pain. It rattled her to her core.</p>  <p>As I sat with her and held space for her, all I could do is bear witness to her process. I told her that the most powerful gift she could give the grieving mother was her presence. Bearing witness is a gift we can offer each other at any time. In a world that is moving at warp speed, it is easy to forget that we matter. Since we don’t live in communities like we once did that marked our passages and witnessed our lives, it is common to spend our milestones alone. Once they pass, people get occupied again with their busyness and forget that we are in process. When a person experiences a loss, the process through grief takes time. It is important for them to be supported through its different stages.</p>  <p>Bearing witness is a sacred act. It even changes the one who bears witness. It deepens and fortifies one’s soul. It makes one trustworthy.</p>  <p>As a person’s grief transforms and shifts through its various stages, one gains access to the inner endurance that lives within. The vacuum that is left in one’s life is somehow filled with memories and a deeper level of wisdom. This is an alchemical process. The pain of loss never goes away, but it changes form and also changes the griever in profound ways. Without bearing witness, one could never experience the power of Soul in process.</p>  <p>Many of us feel alone in our process. This is not good for our health. We feel isolated. We may feel that our process is a burden on others. Isolation is one of the most profound stressors on Earth. Being witnessed, on the other hand, makes us feel like we matter. Mattering is good for our health. It makes our life worth living.</p>  <p>Mattering is a form of love.</p>  <p>As a physician, I feel that bearing witness is the most sacred part of what I do each day. Holding space and bearing witness to sometimes unbearable suffering deepens my heart and fortifies my soul. It makes my patients feel that they matter, that their pain and suffering matters. To be asked to bear witness for another is a profound honor. Life presents us with so many ways to bear witness to each other every day. We must embrace these opportunities for loving.</p>  <p>Like Ann, who will be changed forever by her witnessing, we must hold our strong arms around each other with open hearts. As Ann bears witness to a grieving mother, I bear witness to Ann. Somehow, I feel that my arms are around her and this mother, all at the same time. My heart is open to holding space for all of this. For me it is a great honor and a blessing.</p>  <p>Making another feel like they matter also makes my life matter. Isn’t this ultimately what we are on Earth to experience?
