With a nudge from Bill Clinton, Democrats seek to tweak health law [ BeritaTerkini ]

<div id="yom-ad-LREC" class="yom-ad yom-ad-LREC"> <center> <div id="yom-ad-LREC-iframe" class="yom-ad"></div> </center> </div> <p><br></p> <p>By Roberta Rampton and Thomas Ferraro</p> <div class="body-slot-mod"> <div class="yom-remote"> <div class="yom-loading" id="mediacontentrelatedstory_container"></div> </div> </div> <p>WASHINGTON (Reuters) – The growing pressure on President Barack Obama to adjust his problem-plagued healthcare law seemed to boil over on Tuesday, as leaders of Obama’s Democratic Party called on him to allow a change in the law so that Americans who are happy with their health plans could keep them.</p> <p>In what became the clearest sign yet of Democrats’ increasing anxiety over the troubled rollout of the healthcare law, former President Bill Clinton told the web magazine Ozymandias that Obama should support such a change to fulfill a promise he and his administration have made to Americans for years.</p> <p>“I personally believe, even if it takes a change to the law, the president should honor the commitment the federal government made to those people and let them keep what they got,” Clinton told the magazine.</p> <p>The comments were significant coming from Clinton, perhaps the most popular figure in the Democratic Party and a longtime supporter of efforts to help millions of uninsured and underinsured Americans obtain coverage for health care.</p> <p>Since the 2010 Affordable Care Act went into effect on October 1, millions of Americans have discovered their current plans were being canceled because the plans did not meet minimum coverage levels required by the new law, also known as Obamacare.</p> <p>Amid criticism that he had broken his promise to those who want to keep their old health plans, Obama apologized last week for not being more clear in his statements about the law.</p> <p>But the apology did not do much to tamp down a wave of criticism of the president. That criticism – combined with the ongoing problems of the HealthCare.gov that have kept untold numbers of Americans from signing up for coverage under the new law – appeared to push at least some Democrats to a breaking point on Tuesday.</p> <p>Hours after Clinton’s comments, the U.S. Senate’s No. 2 Democrat, Richard Durbin of Illinois, said that although the White House has long resisted alterations to the Affordable Care Act, Democrats should be open to “constructive changes” to improve the law also known as Obamacare.</p> <p>Another influential senator, California’s Dianne Feinstein, issued a statement shortly afterward, saying that she would join Senator Mary Landrieu, a Louisiana Democrat, in sponsoring a bill that would allow Americans to keep their current insurance plans, even if the plans do not meet the new law’s standards for coverage.</p> <p>“Too many Americans are struggling to make ends meet,” Feinstein said in a statement. “We must ensure that in our effort to reform the healthcare system, we do not allow unintended consequences to go unaddressed.”</p> <p>For Republicans who opposed Obamacare and have long been critical of virtually every aspect of the law and the administration’s promotion of it, Tuesday’s message was: I told you so.</p> <p>Republican House Speaker John Boehner of Ohio said the comments from Democrats signaled “a growing recognition that Americans were misled when they were promised that they could keep their coverage.”</p> <p>Republican House leaders have scheduled a vote for later this week on a bill offered by Republican Fred Upton of Michigan that is similar to the Senate bill co-sponsored by Landrieu and Feinstein.</p> <p>Landrieu is among a dozen Democratic senators for whom fixing Obamacare is politically urgent because they face tough reelection campaigns next year.</p> <p>‘THROWING THE BABY OUT’</p> <p>White House spokesman Jay Carney, commenting before Feinstein’s announcement, said Tuesday that Upton’s House bill would cause problems for insurers who were trying to sell plans that met the basic standards of the new law.</p> <p>“We do not see that as fixing the problem – we see that as throwing the baby out with the bath water,” Carney said. “That would cause more problems and create more problems, and do more harm than any good.”</p> <p>Carney also said the administration is searching for a way to help those facing cancellations. He did not provide details.</p> <p>The House vote – and the potential for a similar vote in the Democrat-led Senate on the Landrieu/Feinstein plan – mean that Democrats likely will have to cast another vote on the healthcare law before next year’s midterm elections, which will decide the balance of power in Congress.</p> <p>ENROLLMENT REPORT DUE</p> <p>Beyond the flap over canceled coverage and the website’s problems, the administration has acknowledged that the first report of enrollment in the healthcare program – due later this week – will be underwhelming.</p> <p>The Wall Street Journal has reported fewer than 50,000 Americans were able to sign up for new Obamacare health insurance plans in 36 states in October through HealthCare.gov. The administration would not confirm the number, but it has said that enrollment data will be released this week.</p> <p>The 2010 Patient Protection and Affordable Care Act requires that most Americans at least be enrolled for health insurance by March 31 or pay a fine. <div id="yom-ad-LREC" class="yom-ad yom-ad-LREC"> <center> <div id="yom-ad-LREC-iframe" class="yom-ad"></div> </center> </div> <p><br></p> <p>By Lacey Johnson</p> <div class="body-slot-mod"> <div class="yom-remote"> <div class="yom-loading" id="mediacontentrelatedstory_container"></div> </div> </div> <p>WASHINGTON (Reuters) – Putting killer whales and their trainers together in close proximity is an important part of SeaWorld’s shows, the marine park operator said on Tuesday in asking a federal court to overturn an order to put more space between orcas and humans.</p> <p>The case resulted from the February 2010 death of Dawn Brancheau, a 40-year-old marine life trainer at SeaWorld Entertainment Inc’s Orlando park, and a U.S. Labor Department safety order that came after that tragedy.</p> <p>Brancheau drowned when a 12,000-pound (5,440-kg) bull killer whale, or orca, named Tilikum pulled her into a pool.</p> <p>Close interaction between whales and humans is “the premise of SeaWorld’s entertainment,” the company’s attorney, Eugene Scalia, told a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit.</p> <p>The Labor Department order is like the “government came in and told the NFL (National Football League) that close contact on the football field would have to end” for safety reasons, said Scalia, son of Supreme Court Justice Antonin Scalia.</p> <p>Six months after Brancheau’s death, the Occupational Safety and Health Administration (OSHA) said SeaWorld had exposed its trainers to a hazardous environment, violating the Occupational Safety and Health Act’s “general duty” clause.</p> <p>OSHA, part of the Labor Department, ordered SeaWorld to make changes, including physically separating trainers and orcas during performances.</p> <p>OSHA also fined SeaWorld $ 75,000 for three safety violations. An administrative law judge of the Occupational Safety and Health Review Commission reduced the fine last year to $ 12,000 after downgrading one of the violations.</p> <p>GENERAL DUTY CLAUSE</p> <p>The “general duty” clause says employers must keep workplaces free from recognized hazards. The clause “cannot be used to force a company to change the very product that it offers the public, and the business it is in,” SeaWorld wrote in an appellate brief.</p> <p>The Labor Department defended its invoking of the clause, saying the safety hazards at SeaWorld could be prevented without threatening the company’s survival.</p> <p>“The distinction is that the acts that SeaWorld claims are inherent to their business model are, in fact, not inherent to their business model,” said Department of Labor attorney Amy Tryon during the hearing at Georgetown University’s Law Center.</p> <p>“We know that SeaWorld is able to make a reduction in risk to its employees because SeaWorld has done that.”</p> <p>DEEP WATER LIMIT</p> <p>Scalia said that SeaWorld had modified its shows following Brancheau’s death, and trainers were no longer allowed to enter deep water with killer whales.</p> <p>“What is the nature of the product?” asked Judge Brett Kavanaugh during Tryon’s remarks. “That’s the concern I have about this case.”</p> <p>Scalia said the ruling against SeaWorld should be dismissed because a previous judge relied on testimony from an unqualified expert witness with limited knowledge of whale behavior in captivity.</p> <p>The appellate judges have yet to rule.</p> <p>Two animal-rights groups – People for the Ethical Treatment of Animals and the Animal Legal Defense Fund – have filed with an amicus brief to support the Labor Department. The groups wrote in the brief that prolonged captivity has forced the orcas to behave aggressively.</p> <p>Shares in SeaWorld were up 2.4 percent at $ 31.96 in mid-afternoon trading.</p> <p>The case is SeaWorld of Florida v. Michigan State. Harris had a chance to play professionally but passed on the NBA to return to East Lansing, and he's back as the Spartans' best overall player. He creates for others and can get to the rim at ease. You're bound to have a deep roster when you bring in six McDonald's All-Americans. Texans release Reed, place Foster on IR

<div xmlns='http://www.w3.org/1999/xhtml'>The Sports Network<br /><p>Houston, TX (SportsNetwork.com) - The Houston Texans made it official on Tuesday, releasing veteran safety Ed Reed after less than one season with the club and placing running back Arian Foster on injured reserve.</p><br /><p>Reed signed a three-year, $15-million deal with the Texans in the off-season. However, injuries and off-season surgery denied him time on the field at the beginning of the year. He saw his first action with the club in Week 3 and recently lost his starting job.</p><br /><p>The Miami-Florida product had spent his entire 11-year career with in Baltimore after the Ravens selected him with the 24th overall pick of the 2002 draft. Reed has led the league in interceptions three times, totaling 61 in 160 career games. He has taken a pick back for a touchdown seven times.</p><br /><p>A nine-time Pro Bowl selection, Reed helped the Ravens to the Super Bowl last season. He had four interceptions and 58 tackles in 16 regular-season games last year.</p><br /><p>This season, he has just 16 combined tackles in seven games.</p><br /><p>Foster's season is officially over thanks to a back injury. <div id="yom-ad-LREC" class="yom-ad yom-ad-LREC"> <center> <div id="yom-ad-LREC-iframe" class="yom-ad"></div> </center> </div> <p><br></p> <p>By Lawrence Hurley</p> <div class="body-slot-mod"> <div class="yom-remote"> <div class="yom-loading" id="mediacontentrelatedstory_container"></div> </div> </div> <p>WASHINGTON (Reuters) – The Supreme Court took on cases involving a heroin overdose and a drug deal gone wrong on Tuesday as the justices weighed what prosecutors needed to prove in order to convict defendants of certain federal offenses.</p> <p>In both cases, the justices appeared unsure how to proceed as they considered the appeals of two criminal defendants, Marcus Burrage and Justus Rosemond.</p> <p>Burrage was convicted in a federal court in Iowa of distributing heroin that led to the death of a drug user while Rosemond was convicted in a Utah federal court of aiding and abetting the use of a firearm during drug trafficking. Both convictions were upheld on appeal.</p> <p>In each case, the defendants are appealing lengthy prison sentences. Burrage was sentenced to 20 years on the heroin death count, although he is serving it concurrently with his 20-year sentence for selling heroin. Rosemond’s conviction on the firearms count led to a 10-year prison term on top of the four-year term he received for other offenses.</p> <p>In Burrage’s case, he argued that the government needed to show that the heroin that led to the death of Joshua Banka in Iowa in November 2009 was more than just one possible cause of death. At trial, experts said only that the heroin was a contributing factor to Banka’s death as he had also ingested other drugs at the time of his death, Burrage’s lawyers point out.</p> <p>Several justices expressed concern about the latitude the government has in prosecuting cases under the law, which imposes a mandatory minimum 20-year sentence “if death or serious bodily injury” results from use of heroin sold by the defendant.</p> <p>Justice Elena Kagan cited the expert testimony at trial, noting that there was no information on to what extent the heroin was a cause of death.</p> <p>“They had no idea whether it contributed to the death,” she said.</p> <p>DRUG DEAL</p> <p>In the second case, Rosemond was convicted of four offenses relating to a shooting that took place in Tooele, Utah, in August 2007 during an unsuccessful drug deal.</p> <p>Rosemond’s legal team says the government should have to show he took some action to encourage use of the firearm in order for him to be convicted of the aiding and abetting offense, one of four charges he faced. At trial, it was not clear whether it was Rosemond or his accomplice who was the shooter.</p> <p>As in the Burrage case, some of the justices indicated sympathy for Rosemond’s plight. Justice Ruth Bader Ginsburg said it seemed “a bit much” that Rosemond received a 10-year sentence merely for his involvement in an underlying crime that only merited a four-year sentence.</p> <p>It is possible the court will send the case back to lower courts for further review due to concerns raised by some justices about the instructions that were given to the jury.</p> <p>“I think there is a real problem with that,” Justice Anthony Kennedy said.</p> <p>Rulings are expected by the end of June.</p> <p>The cases are Burrage v. United States, U.S. Supreme Court, No. 12-7515 and Rosemond v. MakerBot Wants You to Buy a Teacher a 3D Printer

Blue/Bloomberg</p><br /><p>Bre Pettis was the first kid on his block to have an Apple II computer. The device was intriguing, and all the neighborhood kids tinkered with it endlessly even though it served little practical purpose. Pettis went on to start MakerBot, the 3D printing company, and he sees its products in the same light: maybe they seem silly at first, but the kids will figure them out.</p><br /><p>To get kids playing with 3D printers, Pettis is emulating Apple in another way. On Tuesday, the company announced an ambitious plan to get Makerbot starter kits into classrooms. Apple has always been good at getting into schools; it sold 1.1 million iPads to educational institutions in the quarter that ended in June. These contracts represent a lucrative business opportunity for tech companies, and explain why everyone from News Corp to Amazon is scrambling to get their tablets in front of children.</p><br /><p>Selling a 3D printer to every school would be boon to Makerbot, of course, but the company hasn't lined up any public contracts. Instead, the company's education initiative is based on crowdfunding. The kits it sells, which include the company's Republicator 2 printer, some of the raw material needed to make objects, and a service plan from the company, cost about $2,550. Teachers who want one go onto DonorsChoose, a crowdfunding site for schools, and describe what they would do with the printer. They are allowed to raise everything but $98 on the site. The rest they have to come up with offline, either by paying for it themselves, or getting the PTA or parents to chip in. This kind of not-quite fully funded grant lessens the chances of the printers going to waste, says Pettis.</p><br /><p>MakerBot and DonorsChoose describe this as a plan to get a 3D printer in every school in the country, but the chances are slim it can reach that scale without help. DonorsChoose projects raised $48 million last year. Even if donors gave all their money to 3D printing projects, that much money would buy about 19,000 printers; there are about 100,000 public schools nationwide. Further, the average project size was $600, or about one-quarter of what a 3D printing kit costs.</p><br /><p>Pettis hopes that corporate donors will fund individual schools. He announced one company that has already signed on: AutoDesk, which makes 3D design software, is funding 500 projects. Pettis also said that he will be 'taking care of Brooklyn' by funding projects in his home borough. While he declined to discuss the dollar amount, DonorsChoose said Pettis's donation was one of the larger individual commitments it has ever received.</p><br /><p>This is clearly a labor of love for Pettis, who once taught public school in Seattle. He says that he has always wanted 3D printing to become part of school, especially at a time when the idea of shop class is fading and students rarely make anything with their hands anymore. He is recently flush, after MakerBot was acquired by Stratasys, the closest thing 3D printing has to an old guard, for $403 million in June. And while a nation of students learning how to operate 3D printers is clearly in the company's interests, Pettis really didn't want to talk about how the program would increase revenue or even how it would hasten the mainstreaming of 3D printing.</p><br /><p>'That's not the focus,' he said.</p><br /></div>

As many potential customers tried to log in to the site, which opened Oct. 1, they received error messages, or, as they tried to create security questions, they were sent back to begin the process again.</p><br /><p>'The site is getting better each week, and by the end of November, the site will be moving smoothly for the majority of users,' Bataille said.</p><br /><p>The administration will be releasing enrollment numbers later this week, Bataille said, although she did not specify a date or time.</p><br /><p>Tuesday's announcement follows a week of leaked and projected insurance exchange enrollment numbers, as well as updates on the progress of HealthCare.gov, which was taken down for several hours over the holiday weekend for more updates and fixes.</p><br /><p><i>The Wall Street Journal</i> reported Monday that only between 40,000 and 50,000 people have enrolled in an insurance plan through the federal exchange. Bataille said she could not confirm that number. However, Health and Human Services Secretary Kathleen Sebelius said last week that the numbers would be low.</p><br /><p>When Massachusetts rolled out its program, just .3% of the enrollees signed up in the first month, Bataille said, repeating an oft-cited statistic.</p><br /><p>'Given the Massachusetts experience, we expect our initial numbers will be low and grow over time,' she said.</p><br /><p>Also on Monday, Avalere Health, a health advisory company, released an analysis showing that 12 state exchanges have enrolled about 3% - or 49,100 people - so far of what they expect to during the six-month enrollment period. Avalere expects those states to enroll 1.4 million people by the end of March.</p><br /><p>Three percent of the target population is 'less than what you want to see at this point,' said Dan Mendelson, Avalere's CEO.</p><br /><p>'But they have time to turn this around,' Mendelson said. 'They have not really started to do the major visibility and advertising push.'</p><br /><p>When Medicare Part D rolled out, only 10% of enrollments had signed up one month later. Another two-thirds signed up after coverage began, Mendelson said.</p><br /><p>Despite the early problems, Mendelson said, failure is not an option for the Affordable Care Act. The Obama administration's political future is too tied to its success or failure, he said. Also, Mendelson added, insurance companies have too much invested in the law.</p><br /><p>'It's slower than what you would expect, but the companies that are offering this insurance are in it for the the long time,' he said. 'They have to be.'</p><br /><p>There has been some good news for the Obama administration this week, as well. New York officials announced today that 48,162 people had enrolled in the state exchange, while 197,011 people had completed the full process and may now enroll in plans.</p><br /><p>And Enroll America, a group devoted to enrolling Americans in the exchanges, said it had reached 302,000 people in person or by phone and has raised $27 million since March to continue its efforts.</p><br /><p>Interest in the exchanges doubled from August to September, and then doubled again from September to October, said Anne Filipic, Enroll America's president. She acknowledged that the website problems had caused a slowdown in progress, but 'we're going back to the folks we've already had a conversation with.' About 30,000 people have said they are uninsured and that they want insurance, she said.</p><br /><p>Bataille said four teams are working to fix software and infrastructure problems. So far, they've doubled the number of servers to meet the high demand, overhauled the account registration process so that they can handle 17,000 registrants per hour, tested the system to create a list of things that need to be fixed, and replaced a virtual database with a 'high capacity physical database.' She said they've reduced the error rate from 6% to 2%.</p><br /><p>They fixed 'dozens' of issues, Bataille said, such as creating user alerts so people know they can't use subsidies on catastrophic coverage, as well as allowing people to upload documents to the system.
