Verizon admits network faces traffic pressure in big cities

<div xmlns='http://www.w3.org/1999/xhtml'><p>The company is pouring money into the problem, and a top executive says the issues will dissipate by the end of the year.</p><br /><p><img src="http://asset3.cbsistatic.com/cnwk.1d/i/tim/2012/12/05/Roger_Cheng_60x43.jpg" width="600"/> </p><br /><img src="http://asset3.cbsistatic.com/cnwk.1d/i/tim/2012/01/08/Verizon_LTEPower.png" width="600"/><br /><p>(Credit: Jessica Dolcourt/CNET)</p><br /><p>Verizon Wireless is feeling the crush of all of those LTE-enabled devices on its network.</p><br /><p>The carrier said it facing pressure to deliver increased amounts of bandwidth in big cities such as New York, San Francisco, and Chicago. In a rare admission, Verizon Chief Financial Officer Fran Shammo admitted the rapid growth in traffic was starting to hamper the quality of the service.</p><br /><p>'There are certain pockets where we're absolutely going to experience that down tick from the LTE network down to 3G because of capacity constraints,' Shammo said during an investor conference.</p><br /><p>It's a surprising concession from a company that typically trumps its network superiority as a reason why customers should pay a premium for its wireless services. It has long touted itself as the nation's most reliable, but that claim has since been taken by AT&T, which also boasts the nation's fastest network. Verizon maintains it has the most reliable network, and cites a different study.</p><br /><p>The growth in data traffic is a result of its early move into LTE. Verizon boasts the nation's largest LTE network, and the longest running, which has meant more LTE customers than anyone. And LTE customers like their data. While LTE customers make up a third of the company's total base, they consume 64 percent of the traffic.</p><br />The carriers' not-so-secret weapon to improve cell service<br /><p>Shammo said that in big cities, that percentage is likely higher.</p><br /><p>The result has been a carrier struggling to keep up with data growth, something Shammo concedes has been tough. He said the carrier was taken by surprise in the growth in video traffic from LTE users. While he would say how exactly much more data an LTE user consumes versus a 3G customer, he said it was more than double. Relative to its competition, Shammo said Verizon was growing faster, so data consumption has likewise been accelerating.</p><br /><p>Verizon isn't standing still. Shammo said the company has poured more money into the network, including increasing its capital expenditures by $500 million this year. The company is also investing in small cell technology and turning on more spectrum as it works to build up network capacity.</p><br /><p>'By the end of this year you are going to see all those issues dissipate,' Shammo said. 'And then going into next year we will be ahead of the curve again.'</p><br /><p><img src="http://asset3.cbsistatic.com/cnwk.1d/html/news/clear.gif" width="600"/> </p><br /></div>

Oh, and Gemma took Wendy ( <strong>Drea DeMatteo</strong>) to a new kind of rehab: her own home where she will keep Wendy clean herself. (We bet she's thinking she's getting too old for this shit?!)</p><br /><strong>READ: Catch up on Monday night's OMG TV moments</strong><br /><p>Oh man, is this show hitting its sweet spot. Tonight's outing featured the first official The Vampire Diaries crossover as Tyler ( <strong>Michael Trevino</strong>) made his New Orleans debut and he was on a freakin' mission. In a dark, dark twist, Ty totally down to kill Hayley ( <strong>Phoebe Tonkin</strong>) and her unborn baby to exact revenge on Klaus ( <strong>Joseph Morgan</strong>). And raise your hand if you were literally squealing with delight during Tyler and Klaus' long-awaited faceoff, which revealed that Tyler was basically on a suicide mission after losing everything important to him. Of course, knowing he wanted death, Klaus let him live, compelling him to never forget that he 'means nothing' to him. Way harsh!</p><br /><p>But don't count Tyler out just yet as the revenge-seeking wolf teamed with Marcel ( <strong>Charles Michael Davis</strong>) by episode's end. Game. On. (How great was Trevino in this episode? We can't gush enough over his performance.)</p><br /><p>Other big reveals/shockers? Clearly, that was the moment. 'The Voice' Recap: Instant Save Picks Top 10

But Tuesday's episode wasn't just another clean contestant cut. Because a double elimination on live television just isn't dramatic enough, viewers voted to save a contestant from the bottom three through the 'Instant Save' on Twitter.</p><br /><strong>PHOTOS: 'The Voice' Teams: Meet Season 5's Finalists</strong><br /><p>Once <strong>Carson Daly</strong> revealed that the three contestants with the lowest votes were <strong>Christina Aguilera</strong>'s gritty rocker <strong>Josh Logan</strong>, as well as <strong>Cee Lo Green</strong>' <strong>s</strong> crowd-surfing performer <strong>Kat Robichaud</strong> and military veteran <strong>Jonny Gray,</strong> viewers then had a short five-minute window to jump on Twitter and tweet #VoiceSave with the first name of the contestant they wanted to rescue from elimination.</p><br /><p>This means that for the first time in Voice history, the power of the save was given to the viewers at home (well, really just those watching the live broadcast -- sorry, West Coast fans).</p><br /><p>Though Shelton said he scrolled through his news feed during the commercial break and saw a ton of tweets for Gray, the rocker with the voice of 'activism' was sent home. <p><cite class="byline vcard">By <span class="fn">Roberta Rampton</span> | <span class="provider org">Reuters</span> – </cite></p> <div class="yom-mod yom-art-content" id="mediaarticlebody"> <div class="bd"> <p class="first">By Roberta Rampton</p> <p>WASHINGTON (Reuters) – A top White House technology adviser will testify at a congressional hearing on Wednesday about the troubled launch of the website at the heart of President Barack Obama’s signature healthcare reform despite the administration’s assertions that he was too busy.</p> <p>The White House confirmed late on Tuesday that Todd Park, its chief technology officer, would comply with a subpoena to testify at a hearing of the Republican-controlled House of Representatives Oversight Committee.</p> <p>The White House had asked to delay the hearing until December, saying that Park was too busy helping to fix the HealthCare.gov website, which Obama has vowed will be working smoothly for most people by the end of the month.</p> <p>Technical problems with the website since its October 1 rollout have prevented many Americans from enrolling in the health exchanges set up under the 2010 healthcare law, also known as Obamacare.</p> <p>“The partisan subpoena issued by House Republicans on Friday was an unfortunate and unnecessary step since we made clear several times that Todd Park is willing to testify,” said Rick Weiss, a spokesman for the White House Office of Science and Technology Policy.</p> <p>“It wasn’t a question of if, it was a question of when,” Weiss said.</p> <p>Park was a successful healthcare IT developer before he joined the Obama administration, steering Athenahealth through a blockbuster IPO, and helping start another company, Castlight, which provides data on healthcare costs.</p> <p>A sought-after speaker at IT conferences, Park is popular within the technology community. More than 1,200 allies signed a petition at lettoddwork.org calling on Darrell Issa, the Republican committee chairman, to postpone Park’s testimony.</p> <p>“No matter what side of the aisle you sit on, Todd is one of the good guys. Let him do his job,” the petition said.</p> <p>Park, 40, helped build the original HealthCare.gov website in 2010 when he was chief technology officer at the Department of Health and Human Services. Motorola Web Traffic Gets Boost From Moto X

<div xmlns='http://www.w3.org/1999/xhtml'><p><img src="http://www7.pcmag.com/media/images/356029-motorola-logo.jpg?thumb=y" width="600"/> </p><br /><p>Motorola isn't exactly making Samsung quake in its Android-powered boots, but the phone maker's new Moto X is helping its mobile Web traffic numbers.</p><br /><p>Web traffic generated by Moto X users since the flagship smartphone's August release continues to grow, according to online ad network Chitika.</p><br /><p>Based on a sampling of tens of millions of U.S. and Canadian online ad impressions from Oct. 1 to 31, Motorola ended the month with 4.1 percent share of North American smartphone Web traffic. The Moto X alone earned 1.8 percent of that.</p><br /><p>Those numbers are helping Motorola gain on HTC, which dipped 0.1 percent over the month. Motorola grew from 3.6 percent to 4.1 percent — barely behind HTC's 4.2 percent share on Oct. 31 (chart below).</p><br /><p>'With HTC still struggling to find a new 'hit' smartphone in the North American market, combined with Motorola's slate of new product releases, it is reasonable to assume that Motorola usage share will likely surpass HTC's share in the near future,' according to Chitika.</p><br /><p>That takeover would put Motorola in second place, behind Samsung, in terms of continental Android Web traffic. Of course, the Korean smartphone giant has a hefty lead, as Chitika reported in July — Samsung accounts for more than 47 percent of all North American Web traffic.</p><br /><p>Still, Motorola stepping into the No. 2 spot 'would exemplify the upward trajectory its usage share has taken of late on the heels of the Google takeover and its new device lineup,' Chitika said.</p><br /><p>Google officially closed its $12.5 billion acquisition of Motorola Mobility in May 2012, more than a year before unveiling its first major release: the Moto X. The 4.7-inch smartphone runs Android 4.2.2, and sports a 10-megapixel rear camera and a 2-megapixel front-facing shooter. It sports many of the same features as Motorola's new Droid lineup, but the Moto X adds the ability to customize colors, features, and accessories - something that extended to all major U.S. carriers just this week. The phone also got a price cut to $99 recently.</p><br /><p>Motorola is expected to expand its Moto smartphone family this week, with a mysterious Moto G reveal tomorrow. With a nudge from Bill Clinton, Democrats seek to tweak health law [ BeritaTerkini ]

<div id="yom-ad-LREC" class="yom-ad yom-ad-LREC"> <center> <div id="yom-ad-LREC-iframe" class="yom-ad"></div> </center> </div> <p><br></p> <p>By Roberta Rampton and Thomas Ferraro</p> <div class="body-slot-mod"> <div class="yom-remote"> <div class="yom-loading" id="mediacontentrelatedstory_container"></div> </div> </div> <p>WASHINGTON (Reuters) – The growing pressure on President Barack Obama to adjust his problem-plagued healthcare law seemed to boil over on Tuesday, as leaders of Obama’s Democratic Party called on him to allow a change in the law so that Americans who are happy with their health plans could keep them.</p> <p>In what became the clearest sign yet of Democrats’ increasing anxiety over the troubled rollout of the healthcare law, former President Bill Clinton told the web magazine Ozymandias that Obama should support such a change to fulfill a promise he and his administration have made to Americans for years.</p> <p>“I personally believe, even if it takes a change to the law, the president should honor the commitment the federal government made to those people and let them keep what they got,” Clinton told the magazine.</p> <p>The comments were significant coming from Clinton, perhaps the most popular figure in the Democratic Party and a longtime supporter of efforts to help millions of uninsured and underinsured Americans obtain coverage for health care.</p> <p>Since the 2010 Affordable Care Act went into effect on October 1, millions of Americans have discovered their current plans were being canceled because the plans did not meet minimum coverage levels required by the new law, also known as Obamacare.</p> <p>Amid criticism that he had broken his promise to those who want to keep their old health plans, Obama apologized last week for not being more clear in his statements about the law.</p> <p>But the apology did not do much to tamp down a wave of criticism of the president. That criticism – combined with the ongoing problems of the HealthCare.gov that have kept untold numbers of Americans from signing up for coverage under the new law – appeared to push at least some Democrats to a breaking point on Tuesday.</p> <p>Hours after Clinton’s comments, the U.S. Senate’s No. 2 Democrat, Richard Durbin of Illinois, said that although the White House has long resisted alterations to the Affordable Care Act, Democrats should be open to “constructive changes” to improve the law also known as Obamacare.</p> <p>Another influential senator, California’s Dianne Feinstein, issued a statement shortly afterward, saying that she would join Senator Mary Landrieu, a Louisiana Democrat, in sponsoring a bill that would allow Americans to keep their current insurance plans, even if the plans do not meet the new law’s standards for coverage.</p> <p>“Too many Americans are struggling to make ends meet,” Feinstein said in a statement. “We must ensure that in our effort to reform the healthcare system, we do not allow unintended consequences to go unaddressed.”</p> <p>For Republicans who opposed Obamacare and have long been critical of virtually every aspect of the law and the administration’s promotion of it, Tuesday’s message was: I told you so.</p> <p>Republican House Speaker John Boehner of Ohio said the comments from Democrats signaled “a growing recognition that Americans were misled when they were promised that they could keep their coverage.”</p> <p>Republican House leaders have scheduled a vote for later this week on a bill offered by Republican Fred Upton of Michigan that is similar to the Senate bill co-sponsored by Landrieu and Feinstein.</p> <p>Landrieu is among a dozen Democratic senators for whom fixing Obamacare is politically urgent because they face tough reelection campaigns next year.</p> <p>‘THROWING THE BABY OUT’</p> <p>White House spokesman Jay Carney, commenting before Feinstein’s announcement, said Tuesday that Upton’s House bill would cause problems for insurers who were trying to sell plans that met the basic standards of the new law.</p> <p>“We do not see that as fixing the problem – we see that as throwing the baby out with the bath water,” Carney said. “That would cause more problems and create more problems, and do more harm than any good.”</p> <p>Carney also said the administration is searching for a way to help those facing cancellations. He did not provide details.</p> <p>The House vote – and the potential for a similar vote in the Democrat-led Senate on the Landrieu/Feinstein plan – mean that Democrats likely will have to cast another vote on the healthcare law before next year’s midterm elections, which will decide the balance of power in Congress.</p> <p>ENROLLMENT REPORT DUE</p> <p>Beyond the flap over canceled coverage and the website’s problems, the administration has acknowledged that the first report of enrollment in the healthcare program – due later this week – will be underwhelming.</p> <p>The Wall Street Journal has reported fewer than 50,000 Americans were able to sign up for new Obamacare health insurance plans in 36 states in October through HealthCare.gov. The administration would not confirm the number, but it has said that enrollment data will be released this week.</p> <p>The 2010 Patient Protection and Affordable Care Act requires that most Americans at least be enrolled for health insurance by March 31 or pay a fine. Cyanogen, the company behind the leading alternative Android firmware CyanogenMod has released the first easy-to-use Android bootloader to the Google Play Store: CyanogenMod Installer.</p><br /><p><img src="http://cdn-static.zdnet.com/i/r/story/70/00/023116/cyanogenmod-installer-200x357.png?hash=AQyvMTAvAG&upscale=1" width="600"/>Say howdy to the easy-to-use Cyanogen alternative Android ROM bootloader. (Credit: Cyanogen)</p><br /><p>While it's not as simple as click, download, and boot your new Android, the CyanogenMod Installer and its accompanying Windows program, makes upgrading Android devices easier than ever before.</p><br /><p>At this time there are only a few dozen devices supported by the Installer. These are all members of the Google Nexus, Samsung Galaxy, and HTC One lines.</p><br /><p>You will also need a Windows PC for the CyanogenMod Installer. This assistant program works with Windows Vista, 7, and 8. It does not work with Windows XP. There are plans for a Mac OS X Installer, but none for Linux at this time.</p><br /><p>With the pair of programs, you can upgrade the supported devices from their existing version of Android to the CyanogenMod 10.2 M1 Release. This is a version of Android 4.3.</p><br /><p>For now, there is no version of CyanogenMod for Android 4.4 'KitKat'. The newly minted Android company is working on this.</p><br /><p>'We will continue to work on the 10.2 code branch, in parallel to all of our Android 4.4 efforts,' the company said. 'For those that will inevitably ask, we have not made any decisions with respect to what devices will make the leap to the KitKat code base and likely won't have that information for a few weeks.'</p><br /><p>Before jumping into upgrading your device, do keep in mind that this is potentially dangerous for your device. With more than nine million downloads, CyanogenMod may be the most popular alternative firmware. However, most of the people who've used it until now have been Android developers or power users.</p><br /><p>So, to lessen the chances that you'll brick your device, or at least be in a better position to recovery it if you do brick it, be sure to take the following steps.</p><br /><p>First, back up your data. Next (no, really) make sure you backed up your data and that you can read the backup.</p><br /><p>Then, make sure your device's battery is fully charged. After that connect your device directly to the Windows PC with a high-quality USB cable. Do not use a USB hub. You must also turn off your anti-virus program during the process. You should also avoid moving the phone around until the install is complete. The last thing you want is to end up accidentally disconnecting the two during the process. Now, follow the instructions and good luck to you.</p><br /><p>Still want to give it a go? Good luck! <div id="yom-ad-LREC" class="yom-ad yom-ad-LREC"> <center> <div id="yom-ad-LREC-iframe" class="yom-ad"></div> </center> </div> <p><br></p> <p>By Lacey Johnson</p> <div class="body-slot-mod"> <div class="yom-remote"> <div class="yom-loading" id="mediacontentrelatedstory_container"></div> </div> </div> <p>WASHINGTON (Reuters) – Putting killer whales and their trainers together in close proximity is an important part of SeaWorld’s shows, the marine park operator said on Tuesday in asking a federal court to overturn an order to put more space between orcas and humans.</p> <p>The case resulted from the February 2010 death of Dawn Brancheau, a 40-year-old marine life trainer at SeaWorld Entertainment Inc’s Orlando park, and a U.S. Labor Department safety order that came after that tragedy.</p> <p>Brancheau drowned when a 12,000-pound (5,440-kg) bull killer whale, or orca, named Tilikum pulled her into a pool.</p> <p>Close interaction between whales and humans is “the premise of SeaWorld’s entertainment,” the company’s attorney, Eugene Scalia, told a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit.</p> <p>The Labor Department order is like the “government came in and told the NFL (National Football League) that close contact on the football field would have to end” for safety reasons, said Scalia, son of Supreme Court Justice Antonin Scalia.</p> <p>Six months after Brancheau’s death, the Occupational Safety and Health Administration (OSHA) said SeaWorld had exposed its trainers to a hazardous environment, violating the Occupational Safety and Health Act’s “general duty” clause.</p> <p>OSHA, part of the Labor Department, ordered SeaWorld to make changes, including physically separating trainers and orcas during performances.</p> <p>OSHA also fined SeaWorld $ 75,000 for three safety violations. An administrative law judge of the Occupational Safety and Health Review Commission reduced the fine last year to $ 12,000 after downgrading one of the violations.</p> <p>GENERAL DUTY CLAUSE</p> <p>The “general duty” clause says employers must keep workplaces free from recognized hazards. The clause “cannot be used to force a company to change the very product that it offers the public, and the business it is in,” SeaWorld wrote in an appellate brief.</p> <p>The Labor Department defended its invoking of the clause, saying the safety hazards at SeaWorld could be prevented without threatening the company’s survival.</p> <p>“The distinction is that the acts that SeaWorld claims are inherent to their business model are, in fact, not inherent to their business model,” said Department of Labor attorney Amy Tryon during the hearing at Georgetown University’s Law Center.</p> <p>“We know that SeaWorld is able to make a reduction in risk to its employees because SeaWorld has done that.”</p> <p>DEEP WATER LIMIT</p> <p>Scalia said that SeaWorld had modified its shows following Brancheau’s death, and trainers were no longer allowed to enter deep water with killer whales.</p> <p>“What is the nature of the product?” asked Judge Brett Kavanaugh during Tryon’s remarks. “That’s the concern I have about this case.”</p> <p>Scalia said the ruling against SeaWorld should be dismissed because a previous judge relied on testimony from an unqualified expert witness with limited knowledge of whale behavior in captivity.</p> <p>The appellate judges have yet to rule.</p> <p>Two animal-rights groups – People for the Ethical Treatment of Animals and the Animal Legal Defense Fund – have filed with an amicus brief to support the Labor Department. The groups wrote in the brief that prolonged captivity has forced the orcas to behave aggressively.</p> <p>Shares in SeaWorld were up 2.4 percent at $ 31.96 in mid-afternoon trading.</p> <p>The case is SeaWorld of Florida v. Thomas E.
