It may even lead to the US no longer being viewed as a good place to issue sovereign debt. At the very least, it renders non-viable all debt restructurings under the standard debt contracts. In the process, a basic principle of modern capitalism – that when debtors cannot pay back creditors, a fresh start is needed – has been overturned.</span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">The trouble began a dozen years ago, when ARGENTINA had no choice but to devalue its currency and default on its debt. Under the existing regime, the country had been on a rapid downward spiral of the kind that has now become familiar in GREECE and elsewhere in EUROPE. Unemployment was soaring, and austerity, rather than restoring fiscal balance, simply exacerbated the economic downturn.</span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><br /></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><span style="color: #cc0000;"><b style="mso-bidi-font-weight: normal;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">DEVALUATION AND DEBT RESTRUCTURING WORKED</span></b><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">. </span></span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><br /></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">In subsequent years, until the global financial crisis erupted in 2008, ARGENTINA’S annual GDP growth was 8% or higher, one of the fastest rates in the world.</span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">Even former creditors benefited from this rebound. In a highly innovative move, ARGENTINA exchanged old debt for new debt – at about 30 cents on the dollar or a little more – plus a GDP-indexed bond. The more ARGENTINA grew, the more it paid to its former creditors.</span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><br /></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">ARGENTINA’S interests and those of its creditors were thus aligned: both wanted growth. It was the equivalent of a “Chapter 11” restructuring of AMERICAN corporate debt, in which debt is swapped for equity, with bondholders becoming new shareholders.</span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">Debt restructurings often entail conflicts among different claimants. That is why, for domestic debt disputes, countries have bankruptcy laws and courts. But there is no such mechanism to adjudicate international debt disputes.</span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><br /></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">Once upon a time, such contracts were enforced by armed intervention, as MEXICO, VENEZUELA, EGYPT, and a host of other countries learned at great cost in the nineteenth and early twentieth centuries. After the ARGENTINE crisis, President George W. Bush’s administration vetoed proposals to create a mechanism for sovereign-debt restructuring. As a result, there is not even the pretense of attempting fair and efficient restructurings.</span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><br /></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">Poor countries are typically at a huge disadvantage in bargaining with big multinational lenders, which are usually backed by powerful home-country governments. Singer</b> – saw ARGENTINA’S travails as an opportunity to make huge profits at the expense of the ARGENTINE people. They bought the old bonds at a fraction of their face value, and then used litigation to try to force ARGENTINA to pay 100 cents on the dollar.</span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><br /></div><div class="MsoNormal" style="line-height: normal; text-align: justify;"><span style="font-size: small;"><span style="font-family: "Times New Roman","serif";">AMERICANS have seen how financial firms put their own interests ahead of those of the country – and the world. The vulture funds have raised greed to a new level.</span></span></div><span style="font-size: small;"> </span><br /><div class="MsoNormal" style="line-height: normal; text-align: justify;"><span style="font-size: small;"><span style="font-family: "Times New Roman","serif";">Their litigation strategy took advantage of a standard contractual clause (called <i>pari passu</i>) intended to ensure that all claimants are treated equally. Incredibly, the US Court of Appeals for the Second Circuit in New York <a href="http://www.gpo.gov/fdsys/pkg/USCOURTS-ca2-12-00105" target="_blank">decided</a>that this meant that if ARGENTINA paid in full what it owed those who had accepted debt restructuring, it had to pay in full what it owed to the vultures.</span></span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><br /></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><span style="color: #cc0000;"><b style="mso-bidi-font-weight: normal;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">LENDERS ARE SUPPOSED TO BE EXPERTS ON RISK MANAGEMENT AND ASSESSMENT</span></b></span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><br /></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">If this principle prevails, no one would ever accept debt restructuring. There would never be a fresh start – with all of the unpleasant consequences that this implies.</span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">In debt crises, blame tends to fall on the debtors. They borrowed too much. The creditors are equally to blame – they lent too much and imprudently. Indeed, lenders are supposed to be experts on risk management and assessment, and in that sense, the onus should be on them. Such contracts should also include collective-action clauses, which make it impossible for vulture funds to hold up debt restructuring. When a sufficient proportion of creditors agree to a restructuring plan (in the case of ARGENTINA, the holders of more than 90% of the country’s debt did), the others can be forced to go along.</span></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><br /></div><div class="MsoNormal" style="line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto; text-align: justify;"><b style="mso-bidi-font-weight: normal;"><span style="font-family: "Times New Roman","serif"; font-size: 12.0pt; mso-fareast-font-family: "Times New Roman";">The fact that the International Monetary Fund, the US Department of Justice, and anti-poverty NGOs all joined in opposing the vulture funds is revealing. <a href="https://en.wikipedia.org/wiki/Jefferson_%28proposed_Pacific_state%29">There has been talk of this for many years</a>, both in Southern Oregon and Northern California but the Siskiyou County Board of Supervisors finally  voted 4 to 1 to form a new state called "Jefferson".<br /><br /><br /><a href="http://www.rawstory.com/rs/2013/09/04/california-gold-rush-hotbed-siskiyou-county-votes-to-secede-and-form-state-of-jefferson/"><b>California Gold Rush hotbed Siskiyou County votes to secede and form state of ‘Jefferson’</b></a><br /><blockquote>By Arturo Garcia<br /><br />Leaders of a rural Northern California county are inviting communities in both California and Oregon to join them after voting on Tuesday to pursue seceding from the state.<br /><br />The Redding Record Searchlight reported that the Siskiyou County Board of Supervisors approved a plan to form their own state, “Jefferson,” in a 4-1 vote, citing a lack of representation at the state level and complaints about a $150 fire prevention fee for homeowners in smaller counties like Siskiyou.<br /><br />More than 100 residents reportedly packed the meeting, most of them supporting the decision. Only Board Chair Ed Valenzuela voted against the move, arguing that he was elected to uphold the current California state constitution.<br /><br />“I signed on to work within the system I know,” the Los Angeles Times quoted Valenzuela as saying. “I don’t like it, I don’t agree with it all the time, but I did sign up for that and I will continue to do so.”<br /><br />The Times also reported that officials in at least one neighboring county, Humboldt County, is considering a similar plan.<br /><br />“I was one of the people who thinks the state of Jefferson wasn’t a bad idea,” Humboldt County Supervisor Rex Bohn told the Record Searchlight. “There has been a total lack of respect of our water rights and the fire fee. Those things may not be important to the rest of the state, but it’s important to us.”<br /><br />Staff members for Rep. Thursday actions are also planned for cities in the East, West, South and Midwest: Baton Rouge, Boston, Chicago, Cincinnati, Dallas, Denver, Miami, Minneapolis, New York, Orlando, Sacramento, San Francisco and Seattle.</blockquote>Walmart protests tomorrow follow strikes last week involving low-wage workers in the <a href="http://teamsternation.blogspot.com/2013/08/LA-port-drivers-strike.html">port trucking</a> and <a href="http://teamsternation.blogspot.com/2013/08/fast-food-strike-sweeps-naton.html">fast-food industries</a>. Walmart workers are fighting back against management retaliation against OUR Walmart supporters, and they are part of a growing movement to raise wages and standards for America's growing population that is trying to survive on poverty wages.<br /><br />Eidelson adds:<br /><blockquote class="tr_bq">Thursday’s rallies will have the largest total turnout by Walmart employees, and the biggest overall number of participants, of any Walmart mobilization since the one-day November 23 strike last year, in which organizers say 400-some workers walked off the job and thousands of supporters turned out to support them. Since then, organizers say hundreds of workers took part in collective confrontations with local management over scheduling on April 24, and over a hundred participated in the longer June work stoppage, which included a week of protests in and around Walmart’s Arkansas hometown. </blockquote><blockquote class="tr_bq">The OUR Walmart campaign has asked the <a href="http://nlrb.gov/" rel="nofollow">National Labor Relations Board</a>, whose pace and penalties labor has long charged are insufficient for protecting workers, to seek an injunction to more quickly address Walmart’s recent alleged retaliation.</blockquote>Last week, <a href="http://teamsternation.blogspot.com/2013/08/la-port-strike-ends-with-return-to-work.html" rel="nofollow">port truck drivers staged a historic one-day strike</a> in their drive to become Teamsters and raise standards at the Port of Los Angeles. <br /><br />While corporations in retail and other low-paying industries are rolling in record profits, low-wage workers represent the fastest-growing segment of American workers and the country's expanding income gap. <br /><br /><a href="http://makingchangeatwalmart.org/" rel="nofollow">Making Change at Walmart</a> wrote in a <a href="http://makingchangeatwalmart.org/2013/09/03/walmart-workers-supporters-plan-for-largest-mobilization-since-black-friday/?utm_source=rss&utm_medium=rss&utm_campaign=walmart-workers-supporters-plan-for-largest-mobilization-since-black-friday" rel="nofollow">statement</a> yesterday:<br /><blockquote class="tr_bq">Economists, labor market experts and others have been increasingly voicing concern about the growing income inequality and its impact on the economy. Walmart, the largest company on the Fortune 500 list, made $16 billion in profit last year, and the majority of owners of the company, the Waltons, have the combined wealth of nearly half of American families. Meanwhile, many Walmart workers continue to earn on average poverty wages of $8.81 an hour.</blockquote><blockquote class="tr_bq">Rather than providing good jobs that American workers need and deserve, Walmart is trying to silence workers who are standing up with their co-workers to live better and spending its time and money trying to deny workers a decent day’s pay. </blockquote><blockquote class="tr_bq">Since June, Walmart has illegally disciplined nearly 80 workers, including firing 20 worker-leaders. More than 100 Unfair Labor Practice charges have been filed with the National Labor Relations Board (NLRB) against Walmart.  </blockquote>Not only do Walmart and other low-wage workers represent a growing part of the labor force, they represent a huge upsurge of collective action against corporate greed and the fight to save the middle class.<br /><br />Teamsters and supporters everywhere are encouraged to stand in solidarity with Walmart workers tomorrow. In the newly updated edition of "<a href="http://www.bing.com/search?q=Expert+R%C3%A9sum%C3%A9s+for+Managers+and+Executives&src=IE-SearchBox&FORM=msns07" style="color: #666666; font-family: Arial; text-decoration: none;">Expert Résumés for Managers and Executives</a>," authors Wendy Enelow and Louise Kursmark stress the importance of a strong résumé for all applicants.<br /><br />"A vital component of your career <a href="http://www.careerbuilder.com/jobs/keyword/management/" style="color: #666666; font-family: Arial; text-decoration: none;">management</a> plan is your résumé, which must instantly position you as a well-qualified and highly competitive candidate," the authors say. "The easiest way to accomplish that objective is by developing a powerful, performance-based résumé."<br /><br />In their book, Enelow and Kursmark provide numerous résumé samples, divided by career field, that are aimed at people at all levels of management, from front-line <a href="http://www.careerbuilder.com/jobs/keyword/supervisor/" style="color: #666666; font-family: Arial; text-decoration: none;">supervisors</a> to top-level<a href="http://www.careerbuilder.com/jobs/keyword/executives/" style="color: #666666; font-family: Arial; text-decoration: none;">executives</a>. They also offer nine strategies for writing effective résumés:<br /><br /><strong>1. Write for the job you want:</strong> "You cannot write an effective résumé without knowing, at least to some degree, what type or types of positions you will be seeking."<br /><br /><strong>2. Sell it to me, don't tell it to me:</strong> "If you 'tell it,' you simply state facts. If you 'sell it,' you promote it, advertise it and draw attention to it."<br /><br /><strong>3. Use keywords:</strong> "Keywords are ... specific to a particular industry or profession. When you use these words and phrases, you are communicating a specific message."<br /><br /><strong>4. Use the "big" and save the "little":</strong> "Try to focus on the 'big' things -- revenue and profit growth, new initiatives and ventures, special projects, cost savings ... then save the 'little' stuff -- the details -- for the interview."<br /><br /><strong>5.</strong> <b>Make your résumé "interviewable":</b> After "you are contacted for a telephone or in-<a href="http://www.blogger.com/blogger.g?blogID=6253558023578505388" name="_GoBack" style="color: #000099; font-family: Arial; text-decoration: none;"></a>person interview, your résumé becomes all-important in leading and prompting your interviewer during your conversation."<br /><br /><strong>6. Eliminate confusion with structure and context:</strong> "Be consistent, make information easy to find and define the context in which you worked."<br /><br /><strong>7.</strong> <b>Use function to demonstrate achievement:</b> "A résumé that focuses on your job functions can be dry and uninteresting and says little about your unique activities and contributions."<br /><br /><strong>8. Remain in the realm of reality:</strong> "Do not push your skills and qualifications outside the bounds of what is truthful."<br /><br /><strong>9. Be confident:</strong> "There is only one individual with the specific combination of employment experience, qualifications, achievements, education and technical skills that you have."<br /><br />"Your résumé can have tremendous power and a phenomenal impact on your job search. So don't take it lightly," Enelow and Kursmark say.
